A collegial governing body is what?

The phrase "collegiate management body" quite often flashes in the media, in business literature, in documentation. Let's try to understand in detail what it means in general, and also in narrow specializations.

In the broadest sense, the collegial management body is the organization of the executive power, in which the main problems and issues are resolved through joint discussion, discussion, and consideration of the opinion of each member of the board. Correct is the decision of the issue for which the majority speaks. Then this decision is formalized in the form of a legal act and is confirmed by the signature of the chairman of the board. An example of such a body is the Government of the Russian Federation.

Types of collegial bodies

In general, the authorities are divided into single and collegial, depending on the number of persons in charge. Collegiality, in turn, is divided into vertical and horizontal.

Vertical collegiality is one in which subordinate officials participate in the discussion of issues and problems that fall within the competence of higher-level officials.

Horizontal collegiality is a type in which group discussion of problems occurs only among those who have the competence to solve them.

The collegial supreme governing body

It is the authority that has the most general competence and the broadest authority that is the dominant over other government bodies. In the modern Russian system of power they can be called the Government. And, say, the highest collegiate management body in the Bank of Russia is the Board of Directors.

But such a major subdivision of the administration may still have, for example, commercial and non-profit organizations. There, the main purpose that a collegiate management body can have is the responsibility for clearly following the goals for which the organization was created. Its competence extends to the amendment of the charter, the definition of priority lines of activity, participation in the formation of executive bodies, the resolution of issues relating to the disposal of property, the approval of the financial plan, the opening of branches and representative offices, the reorganization and liquidation of the organization.

Public administration

Collegial bodies of state administration are an independent part of the state apparatus, which has a certain sphere of influence, endowed with a public form of power. First and foremost, it is a political organization that necessarily possesses state-power powers. It has the right to issue legal acts that are binding on those to whom these acts are addressed. But at the same time the body of the state apparatus is not entitled to go beyond its clearly limited competence. It is also important that this collegial body should and must demand the execution of its decisions, supervise their implementation. In case of non-compliance, he has the right to use coercive measures against violators.

Thus, the main features of the public administration are:

  • It is necessarily part of the state apparatus;
  • Carries out functions, goals and tasks on behalf of the state;
  • Has the powers of state power;
  • It is definitely a definitely formed cell of human society;
  • It is formed in an order strictly prescribed by law;
  • Has a strictly delineated structure and degree of competence;
  • Is responsible for its activities to the state;
  • Is the executive-administrative authority;
  • Carries out a specific form of state activity - management.

Management of the educational organization

Proceeding from the third part of Article 26 of the Federal Law №273, there must be a sole manager in the educational institution - the rector, the director or the head. And the fourth part of this law provides for collegiate management bodies of the educational organization, which are divided into mandatory and optional.

The obligatory collegiate management body is:

  • The meeting of the employees of this educational institution - in the composition of its powers labor, professional, social and economic issues concerning the employee-leader relationship.
  • The Pedagogical Council is a body of school self-government that decides questions about the quality and level of knowledge of students or students, and increases the level of qualifications of teachers or teachers.

An optional collegiate management body is:

  • The Board of Trustees is a body that monitors the expenditure of material support provided to an educational institution.
  • The Governing Council is the body that includes the parents of students whose decisions are binding on the administration of the organization.
