What problems can the Administrative Code of the Republic of Kazakhstan resolve?

At the moment, the Administrative Code operates on the territory of Kazakhstan. Its main task is to protect the individual, freedom and rights of citizens, protect the environment, public order, etc. The list of relationships regulated by the Administrative Code of the Republic of Kazakhstan includes violations of electoral law, sanitary and epidemiological rules, issues related to business and customs , As well as public order. This is relevant not only for Kazakhstan, but also for Russia, for America and for other countries.

As a punishment, such means as warning, fine, confiscation, administrative arrest or compulsory work are used. In the ordinary domestic sense, the Code of Administrative Violations regulates various relationships that do not have consequences (physical injuries or large material losses).

For example, in public places you can not drink beer, this is a violation of administrative law. It is punishable by a fine. But if, under the influence of a large number of drunk people, a fight starts, someone will suffer and be in hospital, then it will be no longer an administrative but a criminal offense. So, the Administrative Code of the Republic of Kazakhstan is no longer considered here.

Violation of road rules often carries not only administrative but also civil liability. For example, if someone's property was hurt, be it a car or some valuable things. Moving in unauthorized places railway tracks means violating the Administrative Code of the Republic of Kazakhstan. In many countries, including in Kazakhstan, this is punishable by a warning or a fine. But if because of this there was an accident, during which people or property were injured, this could already be a criminal or civil offense. Here, other instances should be connected.

Administrative violations are considered by officials. For example, customs or tax inspectors, police, commission for minors, SES and others. If you do not agree with their decision, you can go to court. A trial can also be used if the punishment that must be applied accordingly to the violation requires a direct decision of the judge, for example in the case of confiscation or administrative arrest. The Administrative Code of the Republic of Kazakhstan can not solve all the issues that arise. In this regard, there is a need for a document to help resolve emerging situations.

In the Administrative Code of the Russian Federation, the last amendment that entered into force was introduced in 2012 by the Federal Law. It determined the order of ticket sales and concerned games that will take place in Sochi in 2014. Currently, the Administrative Procedure Code of the Russian Federation has not yet been adopted, but there has long been a discussion of the need for its creation. All processes of administrative law (production and execution) are governed by the Administrative, Civil or Arbitration Codes. Unfortunately, they do not always allow you to find the right way out of the situation. Therefore, the faster this document comes out, the easier it will be to resolve various disputes.
