Russia introduced a tax on manure

"In Russia there will be a tax on dung from September 1", "Legal chaos", "They went crazy." These and many other phrases could be heard and seen in the vast spaces of the information space. Oppositionists publicly began to inflate news among the electorate, Ukrainian media began to laugh at the fact that we had a tax on manure.

Many patriots did not believe them, they began to assert that this is an informational pre-election throwing of misinformation in order to obtain additional votes. We tried to understand objectively the problem. Is it really the tax on manure introduced in Russia? Has such innovation become a surprise for entrepreneurs? All about this in order.

Tax on manure is a myth or a reality?

When on some resources the inscription "the law" on manure "appears, then we mean now the Federal Law" On Waste of Production and Consumption ", known in our country, adopted as early as 2014. Next, we will call it the Law.

It's not even in him, but in the amendments to it, which equated manure from animals and bird droppings to waste products of the 3rd and 4th class of danger. What does it mean? And the fact that manure is now considered not very dangerous in the sense that it does not hurt at once, but also not safe, so that it can be thrown out so easily by tons on the street.

In fact, the so-called "tax on manure" in Russia does not exist. Licensing of activities is introduced, and this is somewhat different. But we will discuss this in more detail below.

All evil in the world under good intentions

Legislators and ministers scare the figures. Like, millions of tons of manure from farms harm our ecology. Producers of pigs feed chemical "poison", which gets through the "harmful waste" into the soil, thereby polluting it. We do not know how others do, but we have several questions:

  1. If the legislators take so much care of the soil and do not allow the chemistry into manure, then why are they allowed to feed the animals with this very "poison"? Why do the stores on the shelves have meat of birds, which are stuffed with chemicals? That is, people can feed people with such "chemical carcasses," and throwing waste after them without special treatment is dangerous?
  2. Why a license? It turns out that in order to protect our environment, it is necessary to get a bunch of licensing documents? Why not create state centers for waste management in support of agriculture?
  3. Why, before the crises and the budget deficit for many years, manure has always been fertilizer, and now suddenly became a "dangerous waste"? And the volume of production in agriculture during the same Soviet period was much higher than now. Of course, chemistry appeared. But why then the various checks of Rospotrebnadzor, veterinarians and so on? Why do manure from all producers "under one comb" be called hazardous waste?

Money does not smell

Many experts have one conclusion: "Money does not smell." The tax on the production of manure is needed for pumping money from entrepreneurs. The fact is that the goods of enterprises that sell manure as organic fertilizer are in great demand. Especially humus is valued in Central Russia. This is a whole industry in the economy. Many small individual entrepreneurs live on this. In addition, livestock production becomes more cost-effective. In addition to milk and meat, many enterprising farmers sell more manure. Apparently, it decided to stop our state and impose additional extortions.

Trouble crept invisibly?

But you can not say that the law fell like snow on your head. It was adopted in December 2014. It was assumed that the tax on manure in Russia (the license must be received by enterprises that conduct the relevant activities) will appear on January 1, 2016. But manufacturers by this time were not prepared for new requirements and the Ministry of Natural Resources of the Russian Federation was filled with letters with explanations.

Are you crazy?

Many politicians and even heads of regions perceived the law as anti-people. But we will not enter into discussions on this matter. Let's just say that on July 1 the situation with licensing has not improved. The example of Tatarstan is indicative. Of 800 agricultural enterprises, no one got a license. One company applied from Naberezhnye Chelny, but was refused due to insufficient package of documents.

What to do with a single cow?

But the so-called tax on manure in Russia will not affect personal subsidiary farming. It's for now. About what will happen tomorrow, God only knows. Taxes on air, a pipe, a wind, a thunder-storm any more do not seem from area of a fantasy. But while the grandmother, who has only one or two females in her private subsidiary farm, can sleep peacefully. She does not face any tax on manure. Licensing is necessary only for legal entities.

Price of issue

The problem is that, according to experts, an impressive amount will be needed for the producers. From 100 thousand to 1.5 million rubles. - to small producers for waste collection, and from 400 thousand to 20 million rubles. - for large, which will be this manure to utilize.

What does money need?

Of course, the factor of corruption, bureaucracy in the calculations does not go. But maybe the spread of the amount of specialists from 100 to 400 thousand rubles is implied. For large entrepreneurs, it reaches 20 million. But why do we need money? We will answer - in order to implement the requirements of the Law, considerable expenses will be required:

  • For education. Now every tractor driver in a village that transports manure must pass courses with the aim of being allowed to work with hazardous wastes. Of course, some machine operators will be surprised by this. Like, all my life I was transported, and now this is a dangerous production. Naturally, such courses will be paid. For example, in the Belgorod region they cost around 6-10 thousand rubles. But how much their price will be in other regions and how long will the documents be issued is not known.
  • On the equipment of transport. The law provides for special signs and containers.
  • Sanitary-epidemiological conclusions on facilities for collection, storage and disposal (decontamination) of waste.

Now the cattleman is a dangerous profession?

All agricultural producers began to fall asleep departments with all sorts of letters.

What to do in this situation? Storage of manure for more than 11 months necessarily falls under a license, without which a fine is provided. In addition, judging by the Law, any transportation will also fall under it. That is, if an enterprise has a temporary storage facility a few kilometers from the farm, then it also has no right to transport waste pigs without special permission.

The Law stipulates "registration of a license for the collection, transportation, handling, disposal, disposal, disposal of waste of classes I-IV". This means that an ancillary on a farm with pigs must also undergo a training procedure for working with hazardous production. After all, he can collect manure from cows or pigs. And in the Law it says: "collection".

The tractor operator also does not have the right to transport it even to the place where a special operator will come for him, if the enterprise does not have a license, and the employee has permits.

All these actions are actually illegal and are subject to fines. And their sums are impressive. From 10 to 30 thousand rubles from the official, from 100 to 250 thousand - for legal. How the inspection services will react is not yet clear.

Gave the manure - got the article?

If farmers suddenly sell (and even give, judging by the law) the dung to another person, then for this criminal responsibility may come. This refers to illegal business (Article 171 of the Criminal Code). The Law says that a license is necessary "when a legal entity ... manure, litter, other organic substances and materials is sold to third parties on a contractual basis (including on a gratuitous basis)."

Conclusion: even gratuitous transfer of manure should be licensed. And realization without permission is illegal business. From the Law it is clearly traced that "gratuitous basis" also falls under the "realization".

Who is to blame and what to do?

And again our two questions. Who is to blame? This, of course, all of us, citizens of the country. Our deputies do not come from Mars. We elect them during the elections. But what to do? Here are a few options:

  1. Join several small entrepreneurs into a single "holding" to obtain their own license.
  2. Conclude a special agreement with the operator, which she has. They will introduce a tax on manure. In all likelihood, in this case it falls under the category of "environmental fee". Its amount depends on the costs of a specific operator and is not regulated anywhere. That is, if a farmer is told 5 thousand rubles per ton, and there are no other companies that have licenses, then they will have to pay as much as they say. Fines will be more expensive. And now an interesting question. The price for the end consumer in this case will decrease or increase?
  3. All the livestock under the knife and declare the enterprise bankrupt. So the tax on manure in Russia will ruin many unprofitable agricultural enterprises.
  4. Do not have a license and break the law. About the consequences, we said above.

Tax on manure in the Russian Federation: how to obtain a license

There is no license for manure. It is provided for hazardous waste.

But let's say that before you start running around the authorities and departments (and it's not easy), you need to prepare a technological base:

  • Prepare specially equipped and equipped with special signs vehicles.
  • Prepare and include the waste disposal facility in the state register of similar facilities. And this is all possible coordination of environmental assessments, inspections of SES, the Ministry of Natural Resources and so on. In general, it's not an easy thing. The case is quite expensive. Only to store manure it is necessary not less than 12 months on the platform equipped with a firm covering.
  • Obtain a certificate for personnel with a view to admission to work with hazardous waste.

In addition, after obtaining a license, it is necessary to keep a record of manure, monitor the environment, process special equipment, store a certain amount of time (cow dung, for example, from 12 months) and much more.
