Reimbursement of the euro-protocol in case of an accident: execution of documents, maximum payment

Recently, Russian drivers were able to make small accidents without calling traffic police. The document, which in this case is, is called the europrotocol. Let's consider various nuances that are connected with this, including how to issue and receive a refund for the euro-protocol.

The concept of

Europrotocol - a document that allows you to deal with the situation of a minor accident without calling traffic police. Thus, the process of registration is accelerated, after which the participants of the road accident can safely continue their journey. It was introduced to make life easier for the participants of the accident and drivers of other cars passing along the road.
To exercise this right, you need to study the information about this issue in advance. Then mistakes in the actions and compilation of the document are minimized, and therefore the refund of the euro-protocol is obtained without problems.

Consider first the nuances associated with the design. So, if there was a collision, you should:

  • Stop the vehicle and put up a special sign, informing other traffic participants about it;
  • Take a picture of the accident, describe and fix the damage, if possible, evaluate how much repairs will cost;
  • To get information about the participants of the road accident and to find witnesses, if possible.

With the first action - stopping - everything is clear. But with the pictures there may be questions.

Photos, videos and other activities that can help

To make pictures useful to the insurance company, they need to be done correctly. Let us study this in more detail.

  1. First make a few photos of the overall picture of the accident, fixing from different angles.
  2. Then remove traces from braking by the close-up.
  3. After that, the damage is photographed.
  4. The personnel numbers of the other participant in the accident should be included in the footage.
  5. Before you make an accident on the euro-protocol, call the insurance company and notify the incident. At the same time, if you expect to receive a maximum amount of 400,000 rubles or close to it, then the equipment used to make photos and video recordings must meet the government's requirements. Accident, in turn, should be recorded by the satellite navigation system.
  6. If there were witnesses during the crash, try to collect contact data from them. Indications are needed if you have to defend what happened. But this is not a necessity.

Obligatory conditions

Europrotocol is not allowed to issue in all cases. The law specifies the specific conditions under which this procedure is allowed. Reimbursement of the euro-protocol is obtained when there are in aggregate all the mandatory conditions. Let us list them briefly.

  1. In an accident no one should suffer.
  2. The collision occurred only between two vehicles.
  3. Drivers agree with all the conditions and claims put forward to each other.
  4. They left the scene of the accident after the registration of the Europrotocol was completed and the signatures in the document were affixed.

If at least one of the above points does not coincide with your situation, call the traffic police, otherwise you will not be able to get insurance. In addition, it must be remembered that the reimbursement of the euro-protocol has limits.

Procedure

Imagine a situation that satisfies all conditions for self-design. Before us is the document that needs to be filled out.
Let us first consider the general aspects of it.

  1. Registration of the europrotocol is possible only with a ballpoint pen.
  2. It is one of the participants, but both drivers record in the special columns.
  3. The reverse side is filled by each separately.
  4. After drawing up the form is cut, and each of the participants receives their own copy.
  5. In each of them, drivers sign.
  6. Any corrections after separation are unacceptable.
  7. To notify the insurance company, the road accident participant is given three days from the moment of the road accident.
  8. You also need to take a photo and video. These materials are recorded within an hour after the incident. This rule is included in the clearance for CASCO in the current year.

Application

In short, we have already considered the conditions under which a Euro-protocol is drawn up in an accident. Let us distinguish their features.

  1. None of the people in an accident should not suffer. And this applies not only to drivers and passengers of cars involved in the accident, but also pedestrians.
  2. Only in the event of a collision of two cars a document is drawn up without calling the traffic police. If three cars were involved in an accident or, conversely, only one, it is necessary to call an inspector. The same applies to the case if one of the two cars is available with a trailer.
  3. Another important condition is that both one and the other participant in the accident must have the MTPL policy. And it should be checked that the other driver has it in place.
  4. Participants of the road accident should not have any disagreements over the circumstances of the incident. Therefore, it is advisable to check whether one of them in the europrotocol has not completed something that was not agreed upon.
  5. Harm is caused only to vehicles. If the public property has suffered, then an independent registration of an accident is impossible.
  6. All the damages that are caused to the car, you must describe in detail. It is on the basis of this entry that the insurance company calculates a payment.
  7. In addition, one of the participants in the accident must admit the guilt unconditionally. That is, there should be no falsifications and ambiguous statements.

It should be understood that any, even minor errors in filling in can cause refusals on the europrotocol by insurance companies. Therefore, if you have doubts, it is better to call traffic police officers.

Compilation

Forms of notification are issued in the insurance company, where the contract for MTPL is drawn up. If, for some reason, you do not have them, you can contact the insurer to issue a new kit.

The forms are two-sided. They are divided into two columns, which are filled in without fail. On one side, information is provided about participants in an accident, witnesses, the place and circumstances of the accident, causes, damage to cars, and so on. Then the blank is unfastened, and the back side is filled separately.

Front side

Let us pass directly to the filling. Items on the front side are filled especially carefully. All necessary data, insurance information and damage details must be indicated. Consider how to compose those points in which the participants in the accident allow the maximum number of errors.

  1. In the 13th paragraph, the scheme is shown. It should not only be drawn vehicles at the time of the accident, but also the names of streets and roads, displayed nearby fixed objects, traffic lights, road signs and the like.
  2. Damage is fixed at 14 points. Write everything that is visible to the naked eye. Here you should make sure that the other driver does not attribute the parts that broke before the accident. If the damage is not visible, they will be installed after the accident when examined by specialists at the service station.
  3. In paragraph 16 describe the circumstances under which the collision occurred. In this column, note all the details. The situation is analyzed and described very clearly.
  4. In the 17th paragraph, draw a diagram of what happened.
  5. In paragraph 18, the parties sign the document.

After that, the form is divided into parts and filled the other side.

back side

Everything that is described on the reverse side does not show each other. This part is filled by each of the drivers independently. If the form is spoiled, take another, and fill it again. As already noted, there should not be any corrections. If the other participant does not want to fill out the Europrotocol in the event of an accident, call the traffic police immediately, because such actions are unacceptable.

All drivers who have a MTPL policy must have a EuroProlling form, which is issued by the insurance company. In addition, it is desirable for drivers to print out a Euro-protocol-sample for themselves. Then, if an emergency occurs, it's easier to navigate and fill out the document the first time without errors.

The amount of damage

Currently, the legislator fixed the maximum amount of compensation for the euro-protocol. This, in general, is 50,000 rubles. However, there are some exceptions.

  1. So, the amount is only 25 000 rubles, if at least one of the participants of the accident insurance policy of OSAGO concluded before August 2, 2014.
  2. But if the accident occurred in Moscow, St. Petersburg or their regions, the limit on the euro-protocol becomes larger, and is 400 000 thousand rubles. However, this will be possible only if the system "Era Glonass" is introduced in cars . If this does not exist, then it is not necessary to wait for compensation of more than fifty thousand rubles.

There are cases when the examination reveals that the damage caused by an accident exceeds the amount of insurance. Then the driver, who is the culprit of the accident, pays the remaining amount from his own pocket. This is the most unpleasant moment. Having put a signature on the document, he actually recognizes this possibility.

Especially it is necessary to be attentive with machines of the Chinese manufacture. It is often with them, when even after a small collision at low speed damage to the car is serious. Often this is not immediately apparent. Thus, it is not enough to know how to behave in this situation, and what rules of the europrotocol exist. It is important to understand the possible damage to the vehicle.

What could be the problem

Consider some of the nuances that should be taken into account when drafting the Euro-protocol.

  1. If the culprit of the accident is registered in another state and has a green card, then the Euro-protocol is formalized in the usual manner.
  2. If the form contains information that the participants of the accident have disagreements in the event, the insurance company will be declared invalid. Then it will be very problematic to receive compensation for damage on the euro-protocol.
  3. In the presence of discrepancies, employees of the State Traffic Safety Inspectorate must call.
  4. Insurance payments will not be received even if the guilty persons are not indicated in the document. True, photos and video materials can save the situation.

Actions after registration

After the incident and the preparation of the Europrotocol, the actions of the road accident participants are as follows.

The victim within five working days passes to the insurance company a package of documents to receive a refund for the euro-protocol. It includes:

  • Accident notification form;
  • A statement of compensation, which is filled in an arbitrary form (if necessary, you can use the sample provided directly by the insurance company);
  • A carrier with information about the fact of the accident (it can be a memory card with video recording or photos - then it should be noted that no changes and editing of the data was done).

The culprit should also visit his insurance company or send there a notification form. He should not start repairing the car within 15 days after the collision. But if you want to make repairs quickly, then before this car is provided for inspection in the insurance company of another participant in an accident or obtain from there an appropriate permit for repair work.

Problems with payment and drivers tricks

If the insurer, after reviewing the materials provided to it by the injured party, refuses to compensate for the damage, or the amount of damage to the euro-protocol on which the injured party counted is substantially lower, he can sue the insurance company by applying to the court. This possibility is fixed in clause 5 of Article 23 of the Code of Civil Procedure of the Russian Federation. With such a claim they turn to the justice of the peace.

But it also happens that when road users are going to create artificial conditions for the execution of an accident without calling an accident. If someone has abrasions or other damage to the body, it is better not to risk and call the inspector, and if necessary, and an ambulance. If this is not done, extremely unpleasant consequences can occur.

Conclusion

Thus, if you became a participant in an accident, and decide on the choice of the option of registration of an accident, do it consciously. Take into account the recommendations given in the article.

It should be added that during the period of using the europrotocol, the share of insurance payments received as a result of registration in this way is no more than nine percent of all accidents. A small number of accidents, whose participants decided to compose documents without summoning traffic police officers, is explained by the fact that in the collision infrequently it is possible to objectively estimate the amount of damage.
The guilty party always risks that it will not be sufficient to cover the maximum payment on the euro-protocol. The accident will then become ruinous, as it will have to cover the rest of the money from your pocket.
