How to stop smoking in the entrance?

According to estimates of physicians and sociologists, about 40% of Russians are inveterate smokers. The share of smoking men in this volume reaches 60%. These awesome figures pushed our state to take active measures to combat the addiction. But so far, changes in the legislation have not entered into legal force. Therefore, such a common and very common phenomenon, like smoking in the entrance, is keenly worried about our compatriots. Let's talk about it in more detail.

So, is smoking allowed in the entrance? The law in this case sided with the neighbors of the smoker and gives them the right to appeal to the police with a collective complaint with reference to the relevant articles of the Housing Code (Section 2, Article 39, paragraph 3) and the Code of Administrative Offenses (Chapter 6). If you can achieve certain actions on the part of the police, an administrative penalty will be imposed on the smoker for smoking at the entrance, which ranges from 500 to 1,000 rubles. If no measures are taken, then the city prosecutor's office should become the next instance. Turning there with a complaint about police inaction, you are likely to achieve justice with a high degree of probability. Do not be afraid to defend your rights - it's not as difficult as it might seem at first sight.

By the way, modern residents of apartment buildings often seek to solve this problem in a more civilized way. The question of whether to allow smoking in the entrance, rises at the general meeting of homeowners. But, unfortunately, this method can not be called official and legal - the owners of residential premises have absolutely no right to make decisions that endanger the health of people. Well, if at such a meeting tenants manage to peacefully agree on the inadmissibility of smoking in the entrance, then this will help to avoid unnecessary disputes and disagreements.

Surely the vast majority of Russians have already heard about the officially adopted law, which prohibits not only smoking in the entrance, but also in any public places. It will enter into force only in June 2014 and will extend to state institutions, any types of land and air transport, playgrounds, staircases, bars, restaurants, etc. The exception is only specially equipped premises in factories, offices and firms, as well as airports, stations and metro (at a distance of 15 meters from the entrance). Moreover, the so-called "smoking rooms" will have to be equipped with modern air conditioning systems that prevent the spread of tobacco smoke outside the premises. In addition, the walls in them can not be transparent - this measure will protect non-smoking or abandoned addictive employees from excessive temptations.

Thus, smoking in the entrance is an administrative offense and infringement of personal human rights. Turning to the official complaint to the law enforcement agencies, you protect yourself and your loved ones from the negative impact of tobacco smoke. Remember that only bold and decisive measures can lead to the restoration of justice.
