Who is the leader?

According to the dictionary of economic terms (AB Borisov's "Big Economic Dictionary"), managers are a certain category of employees who occupy posts of management both by the enterprises themselves and their structural subdivisions. This includes directors (including general managers), managers, chiefs, chief editors and chief researchers. Also this category includes deputies for the above-mentioned positions.

According to the Labor Code, the head is considered to be an individual who manages the organization in accordance with its constituent documents and regulatory legal acts of the Russian Federation. Including he is the executive body in one person. Thus, the head of the organization is at the same time an employee performing duties under an employment contract and a representative of the firm whose functions include organizational activities and interaction with third parties involved in civil turnover. In his work, he must be guided by the provisions of both labor and civil law.

At the same time, the title of the position of the head may sound differently at enterprises of different forms of ownership - the president, the director (or the general director). This does not contradict the law.

Heads decide all matters relating to the immediate activities of the company, with the exception of those in the competence of the board of directors or general meeting of the founders. He can represent the interests of the company without a power of attorney, issue power of attorney to other employees himself, issue orders for admission, dismissal, disciplinary charges. All norms and rules applicable to any employee are applicable to the manager - to fulfill their duties in accordance with the employment contract in good faith, to comply with the internal regulations and labor discipline, as well as the requirements for labor protection.

Contract with the head

According to the law, before entering into an employment contract with a candidate for the position of a manager, procedures can be provided for ascertaining the suitability of the future head of the post. This can be a contest, a request for disqualification, etc. Information on the disqualification of individuals is in a special register maintained by the Ministry of Internal Affairs of the Russian Federation.

An employment contract with a manager may be unlimited or may be concluded for a certain period of time. As a rule, the validity period of such an agreement is prescribed in the organization's statutory documents. Usually this period does not exceed five years.

The probation period for the persons accepted on competition for a leading post, is not established. For deputy heads, senior managers and heads of departments, the probation period should not exceed six months.

The employment contract for a candidate for leadership positions must include a clause on the non-disclosure of confidential information, the access to which he receives. And also measures of responsibility for violation of this paragraph.

Head of division

An enterprise or organization may consist of several structural units. In particular, if a firm conducts its business not only at a registered legal address, separate subdivisions (branches or representative offices) are created. Such units that are territorially remote from the parent organization have the legal right to represent the interests of the firm and organize stationary jobs.

In such a branch, the head of the division is a full-fledged representative of the firm, who has all the necessary powers. Its functions are similar to the tasks of the management of the parent company, to which it directly reports. In any structural division, managers are the organizers of all current activities and specialists in solving a wide variety of emerging problems.

What else does the head do?

In addition to dealing directly with production issues, managers and senior managers are faced with the task of properly managing personnel policies. The success, competitiveness, economic stability of any enterprise depends on the effective work of employees individually and the team as a whole.

Creation of a single team that can work for the result is the most important goal of the manager. Thus, the head of the enterprise is also a psychologist who solves the issues of motivation, status and role in the team of individual employees, and the rallying of the team.

Senior managers, as well as middle management are recommended:

  • Select groups of people who are close in spirit, moral values, religion, etc. Workplace members of this group have an office at close range. The further the employees are sitting apart, the lower the cohesion in the team.
  • Encourage general activities and collective decisions.
  • To set before the group concrete achievable goals and to stop conflicts.
  • Encourage passive employees and deter too ambitious.
  • To maintain and maintain in the team an atmosphere of cooperation and mutual assistance.
