Regulations of the Council of the Federation: some features

The regulations of the Federation Council of the Russian Federation are the basic document that determines the structure and logic of the work of the upper house of the Russian parliament. It introduces normative procedures, according to which the leadership is elected, the composition and logic of the meetings is formed, as well as the legal methodology for the adoption of bills approved by the State Duma.

The regulations of the Council of the Federation have the force of law, based on constitutional provisions, and binding for all senators. The document itself contains detailed functions and procedures, in particular regarding the establishment of committees, discussion of laws, voting for them. Particular attention is paid to the legal practice of preliminary consideration of bills and work with the State Duma, which, in principle, is understandable. The fact is that the regulations of the Federation Council do not provide for the procedure for drafting the provisions of the draft laws, this is the functional of the State Duma. Another thing is the approval of the already adopted normative acts.

If they are rejected, the document is returned to the lower house for repeated reading. Then he again goes to the Federation Council. In any case, as soon as the required bill passes the "furnace" of the upper chambers, he lays down on the table to the President for final approval. In rare cases, when the head of state imposes a veto on the draft, the Federation Council introduces amendments proposed by the head of state.

In addition, the regulations of the Federation Council provide for a legal tool for adjusting the administrative boundaries of the subjects of the Russian Federation, resolving questions about the introduction of a military or emergency situation, the use of military force abroad, as well as addressing a number of problems related to the early termination of the activities of the head of state or the appointment of early presidential elections. Thus, the upper chamber of the Federal Assembly is responsible for the retention of the entire state structure, and the representation of delegates from all regions in it makes it possible to calmly take into account the interests of the subjects.

The regulations of the Council of Federation are a dynamic document that does not contain rigid constitutional norms. The procedural and methodological issues enshrined in this document may vary depending on internal and external factors. A special regulatory commission is responsible for this. True, we will clarify that this kind of change is a rather rare phenomenon. It is generally accepted that the regulatory points have already been approved and are not subject to revision.

Speaking of particulars, for example, the meetings of the Federation Council are not directly related to the holding of sessions of the State Duma. They may not coincide in time. The main thing is to keep the level of decisions (federal). Laws can be revised at a later date, but not longer than the time set by the Constitution. In general, a list of the most topical issues is discussed at the meetings of special committees. If preliminary hearings do not lead to a compromise solution, the approval of a federal law is postponed to a later date.
