Dacha amnesty - what is it? Extension of the summer amnesty

So, today we will be interested in the so-called dacha amnesty. What it is? What opportunities does it give the population? It is noted that this moment in the legislative system has made life easier for all citizens. Especially for those who use dachas and buildings on land. Privatization of them has always been considered a rather problematic moment. But with dacha amnesty everything became much easier. What should I pay attention to the citizens of Russia? What are the pros and cons of our current system?

Definition

Dacha amnesty - what is it? This issue is mainly of interest to land owners. Especially those who decide on privatization. It has already been said: getting a building on the land is very problematic. But with the dacha amnesty this process is somewhat easier.

The thing is that this is an amendment to the current legislation of the Russian Federation. It acts on Federal Law No. 93 "On Amendments to Certain Legislative Acts on the Registration of Simplified Rights of Citizens to Immovable Property." Initially, it was adopted in 2006, on September 1. Since then, the process of privatizing land and buildings on it has been simplified.

Dacha amnesty - what is it? It is a kind of support for the owners of the land and dachas. This is a kind of accelerator process. Now privatization takes place with less paperwork, and also with less time.

Extension

However, since 2006 the legislation has been constantly changing. And at the same time, there was an extension of the dacha amnesty. At the moment, it will operate until 2020. True, in some cases, the amendment takes place only until 2018.

It is not known whether the amnesty will be extended after the specified dates. But earlier it was done. Thanks to this process, as already mentioned, the owners and potential owners of land plots can formalize buildings and lands in private ownership. For the state, this is not so bad, because then citizens will have to pay taxes on land.

The last extension of the dacha amnesty took place on March 1, 2015. To be more precise, now, by the end of 2020 (until December 31 inclusive), citizens have full right to a simplified system of land privatization. But only land that participates in this process is located in a variety of communities: horticultural, horticultural, dacha. Otherwise, you will be able to process documents only until March 1, 2018 (with the dacha amnesty extended to 2020 inclusive). Such conditions are currently in force in Russia. As already mentioned, it is not known how long our amendment will be prolonged. But the fact remains that dacha amnesty has a favorable effect on the process of getting land into private ownership.

By the way, if we talk about the privatization of buildings on the sites, until 2018 (or rather, before March 1), you can draw up documents for buildings and structures that require special permission. But with an indefinite contract of use, the process is possible before the end of 2020. These restrictions are currently in force in Russia.

Who can participate

Who has the right to use our today's amendment? After all, not everyone has such an opportunity. There are several options for the development of events. It is when:

  • Citizens have a lease on land;
  • A person has a contract for perpetual land use;
  • If the site is in the territory of a community;
  • Under the lease contract / perpetual use of the buildings.

Accordingly, if you own private land, but the buildings on it are not privatized, you can use our today's amendment. It has already been said that the dacha amnesty has been extended until 2020. With a few exceptions, the period is reduced by 2 years.

Timing

Our today's amendment is, as we found out, a kind of accelerator for processing documents. And on the ground, and on the buildings on the site. But how long will the privatization process continue?

No one will tell you the exact time. After all, not everyone can quickly collect documents to start the process. But on average it takes about 2-2.5 months. After applying to the registration chamber, you will be asked to wait for the final decision of the relative privatization month (or 30 days, if more precisely). But that is not all.

In addition, you will have to spend some time collecting all the necessary papers. If you decide to take up the privatization of a house or cottage, a certain time will go to the work of the appraiser. If you lose or damage the documents, you will also have to wait a little. Therefore, the term of 2.5 months is usually considered acceptable. But if you do not take into account the costs of collecting and preparing documents, then the direct decision of the registration chamber should wait no more than 30 days. Fast, simple and very convenient.

Possible difficulties

Was the dacha amnesty extended in 2016? No. All previously adopted amendments are in force. And they extend to these categories of owners or potential owners of land until 2020 (or until 2018, it all depends on your situation). So far it is not known whether the dacha amnesty will be extended. This is not such a big problem for those who have already decided on the design of a site with buildings in the property. What difficulties can be encountered?

The first unpleasant moment is the absence of documents on the right of ownership. Or any other securities that confirm the rights to use the site, as well as facilities. Sometimes it is very problematic to get or restore them.

The second and most common case is the absence in Rosreestr of any information about the land. Accordingly, it is necessary to initially carry out the so-called land surveying of the site, then put it on cadastral records and get the passport with the same name. And only after that you can think about privatization in full.

Also worth noting: if you decide to get a house or cottage in the property, try to initially lead the building into an acceptable form for living. Registration for dacha amnesty is simplified, but it does not provide for any amendments to the assessment of buildings and buildings. It will not be possible to privatize a house that has been declared unfit for habitation.

In some cases, it may be disadvantageous to note the cost. And it is far from being the time. For surveying and evaluation will have to pay. If you do not have almost no documents on the land (they were lost or damaged), you will have to pay for the restoration. Such problems usually do not arise if all the papers are in order.

Accordingly, sometimes among the shortcomings can be noted the length of the procedure. On average, as you have already found out, it takes about 2.5 months to privatize. But if you make out a cadastral passport for land (from scratch), and also conduct land surveying, only these two procedures can take away about six months.

Documentation

Has the dacha amnesty extended after 2020? Not at the moment. And so far there is no substantive discussion of this issue. Therefore, we should hurry with the privatization of the land. To begin with, you will need a certain list of documents. You must present both the originals and their copies. Dacha amnesty requires:

  • Passports of all persons involved in the process;
  • The permission of the guardianship authorities to register property (if there are minors among the owners);
  • Cadastral plans for land and buildings;
  • Any documents confirming the rights to use the site;
  • Technical passport of the land;
  • Payment confirming the payment of state duty (for construction and land separately).

In principle, there are no problems with the collection of documents. Further, this list of documents is attached to a special application. And all this is submitted to the registration chamber. Alternatively, you can use MFC or Rosreestr. It remains only to receive a certificate of ownership rights in the specified time. They will be called to you when you submit documents for privatization.

How much to pay

The law on dacha amnesty provides for simplification of the process of obtaining land in the legal private domain, as well as buildings and structures on it. But no one canceled the state fee. In this case, you will incur certain expenses. They depend on what you decided to privatize. Dacha amnesty - what is it? These amendments are not only advantages, but also some features!

The thing is that you will have to pay 350 rubles for registration of ownership of land. This rule is valid for 2016. But when it comes to the dacha or any other structure, it is necessary for individuals to pay 2,000. And this payment is actual for each building. So, if you privatize a land plot with a house under a dacha amnesty, you will have to pay 2,350 rubles in total. Not too much, but these payments must be remembered. Without them, the registration of property rights does not take place. The state fee is a mandatory payment. Please note: during privatization, you will only need original payment documents.

Declaration / Statement

In order to formalize the ownership of land and buildings on it, future owners are required to fill out a special form. Dacha amnesty simplifies the procedure for privatization, but does not completely relieve the paperwork of citizens. In the application (or declaration) it will be required to indicate some data about the property being registered. Remember, if you incorrectly fill out this document, you have every right to refuse to register. Moreover, these are legitimate grounds for the complete interruption of privatization. Again, you can resume the process, but with the re-submission of the document and filling out the application.

What is indicated in the declaration? There must be information about future owners (passport data), address of the site and buildings, materials of external walls, the area of ownership, number of floors of the house, connection to various communications. If you've made a mistake somewhere, you'll have to fill it in from the very beginning. Usually, no visiting commissions are organized for verification. All data is in Rosreestr. Therefore, it is in these bodies that the verification of the information you have made will be carried out.

The cadastral plan

The law on dacha amnesty simplifies the process of privatizing land and dachas. In some cases, you will not be asked for a cadastral plan of land or facilities. But these are far from the most common cases, but they still take place. So when you can not present a cadastral plan? These are the cases:

  1. When it comes to land allocated for a garden or cottage. At the same time, a building should be erected on it, the availability of which is confirmed by the conclusion of the board of the non-profit organization about this.
  2. Also, you do not have to worry when the land was previously registered and entered in the Rosreestr. If the site data is available in this service, a cadastral passport is not required. You will not be required to.
  3. The last variant of the development of events is the erection of any structure that does not require official certification and construction permits. Only here it is necessary to remember that you will have to show any document that can confirm the fact of the location of the structure within the land plot.

It is not known whether the extension of the dacha amnesty will take place. It has already been said that there is as yet no information on this process. So you should hurry up with the paperwork. If you know all the features of the process, you can privatize the property without problems.

Pros of the system

What can be useful from our current amendments to the law? The shortcomings and pitfalls have already been said. But in fact, not everything is so simple. It is not for nothing that citizens are interested in whether the extension of the dacha amnesty will be extended or not.

First, time costs are among the main advantages. The process of registration of property rights for buildings and sites is significantly reduced.

Secondly, almost complete absence of paper red tape. That is why many want the summer amnesty after 2020 to be extended. After all, you need at least a variety of documents. It is not so difficult to assemble them as it seems. Now it is enough to apply to the MFC for this. This is in case the queue is in the registration chamber. Multifunctional centers are a win-win option, but in this case, the processing of documents will take more time.

Thirdly, they highlight the rapid legalization of the facilities erected on the site. Just a few documents - and you can not be afraid for illegal actions. That's such a dacha amnesty is useful. The registration of private property, expressed land or construction on the site, now does not take you much time.

As you can see, from our current procedure there are mainly some pluses. The main thing is to prepare in advance. Pay attention - from 2016, not issued a certificate of ownership of land or real estate, but a certificate from the Unified State Register of Enterprises. It has indefinite validity. By the way, the extension of the amnesty period is possible after 2020. It happened several times already.
