Certificate TR of TS. Certificate of compliance with the technical regulations of the Customs Union

In order to improve national standards and to bring them to the standards of other countries in Russia, new projects are adopted that regulate and guarantee the quality and safety of products. It's about technical regulations.
Since 2010, when the Customs Union was formed, it was decided to gradually move away from national standards and move towards adopting allied documents. So the certificate TR of the TS began to operate. Let's consider it in more detail.

Technical regulations

Technical regulations (short - TR) - this is a regulatory act, acting in Russia. It establishes the requirements that are imposed on buildings and facilities, processes of production and storage, disposal, maintenance and transportation. The document that confirms the conformity of the products to all established requirements for TR is the certificate of TR TS.

Prior to the emergence of technical regulations on the territory of Russia, the system of GOST R acted mainly. The corresponding certificates were mandatory and were issued precisely on this model.

Certificate of Conformity today

However, they were replaced by technical regulations - more sophisticated and harmonized with international standards. Thus, the certificate TR of the TS is an authorization document confirming the compliance of the products with all the necessary requirements under the technical regulations. This refers to specific types of goods, in relation to which the TR is adopted. The main law regulating this activity is the Federal Law "On Technical Regulation".
The TP system assumes a specific list of products that is subject to mandatory certification procedures. If the product is covered by the Technical Regulations, it is marked as TP in the list.

What are certificates for?

Consider the main groups of goods in relation to which a certificate of TR TS is required. They include the following categories:

  1. Equipment operating on gas fuel.
  2. Low-voltage.
  3. Engineering for use in explosive areas.
  4. Buildings, structures and structures.
  5. Lifts.
  6. Pyrotechnic products.
  7. Products from tobacco.
  8. Individual means of protection.
  9. Food, juices, milk and so on.

As practice shows, getting a certificate of technical regulations means showing a high level of quality and safety of its products for consumers.

The document has the right to receive the seller or the manufacturer. And the design is handled by the certification body or the relevant center. They issue documents on the basis of tests passed in special laboratories equipped with all equipment, where specialists of the required qualifications work. And one and the other organizations should receive state accreditation. And in order to issue documents for the Customs Union, they must be entered in the register of bodies for certification of the Customs Union.

General documents for obtaining a certificate

First, the applicant submits an application to the certification body. The list of documents required for the procedure may vary, depending on the goods, as well as the selected scheme. Usually for certification it is required:

  • Technical documentation for the goods;
  • Technical conditions or other documents by which the products are manufactured;
  • Requisites of the manufacturer;
  • Copies of all his testimonies;
  • Documents (if necessary, certificates) for components, components, spare parts, raw materials and others;
  • After carrying out of corresponding procedures - protocols about tests, measurements and researches.

Registration of certificates TR TS

In order to obtain a certificate of compliance with the technical regulations of the Customs Union, the following actions are taken:

  1. An application is submitted from the manufacturer or seller of the products.
  2. The whole package of documents is prepared and submitted.
  3. The application is reviewed by the certification body.
  4. For testing and research in special laboratories, they pass the appropriate samples.
  5. In some cases, the production process is analyzed.
  6. As a result of the tests, a protocol is drawn up. It is this document that is fundamental in deciding whether to grant a certificate.
  7. The issue of issuing the document is being decided.
  8. The product is labeled. This step is implemented by the applicant independently.

What is reflected in the document?

With the certification can be used different schemes, depending on the type of product and other conditions. For example, a document can be issued for a manufacturer or an importing company. Also, it is issued for single goods, batches or batch production in a single copy. This means that the original will be kept by the manufacturer, but multiple copies will be made from it. Usually a copy for customs authorities is certified by a notary. When preparing the document for the importer, the requisites of this organization, as well as the manufacturer, are indicated. In this case, the applicant has the right to make copies independently and notarize them.

The certificate, among other things, should contain information about the research and tests carried out. Here are the protocols. And to the document make copies from them, which are an integral part.

If you intend to enter too much information into the certificate, then it makes a footnote to the application, which completely describes the necessary data. The annex is also an integral part of the document. Look at the certificate: the photo illustrates its descriptive part.

The form of the current document is somewhat different from that adopted in the GOST system. The certificate of conformity TR of the vehicle is made on a letterhead with several degrees of protection. It reflects the following information:

  • Requisites and company name of the manufacturer;
  • Requisites and name of the certification body;
  • Name and description of products;
  • Unique registration number;
  • Number of the protocol;
  • Period of validity of the document;
  • HS code;
  • date of issue.

Also, additional information may be provided.

Documents for domestic and foreign manufacturers

Consider the documents required for certificates to the domestic manufacturer:

  • Requisites of the manufacturer;
  • application;
  • Product description;
  • Copies of the manufacturer's certificates;
  • All technical and other documentation, according to the requirements for the type of product.

But such a package of documents should be prepared for an applicant who wants to receive a certificate of compliance with the technical regulations of the Customs Union for foreign products:

  • statement;
  • Requisites of the applicant;
  • The name and description of the technical characteristics and properties of the product;
  • Copies of the applicant's certificates;
  • Copies of contracts.

Unlike the document that is valid only in Russia, this certificate can be issued for up to 5 years. But in this case it is supposed to carry out inspection control every year in order to check the products for compliance with the requirements under which the document was issued initially. If the characteristics of the goods are worse, then the certificate can be suspended or stopped altogether.
