Acting head of preschool institution: opportunities and limitations

The official duties of the manager of any institution, including the kindergarten, presuppose ensuring the stable work of the team of employees both during the period of the head of the workplace and during his absence. Absence can be short-term, when the appointment of another person is not required in order to fulfill the duties of a leader (leaving to a higher organization, meeting with a founder or for signing contracts for the provision of a child's institution with food, toys or medical products). And maybe long-term, when the order of the manager appoints the acting head for the period of his absence (for the period of the next vacation, business trip, illness or internship).

In his place, the manager usually appoints a senior educator, methodologist or deputy head of educational work. In modern kindergartens, this is all - the names of the same office, but having different opportunities in the period when the duties of the head of the kindergarten are fulfilled. If the acting manager was previously a senior educator, then transferring him to a new position would be financially unprofitable for him, since his qualification category only applies to the performance of the post of educator in the kindergarten. In the performance of the function of the manager, payment is made without taking into account the qualification category, unless the senior educator has passed certification for two positions in this institution: a tutor and a manager. The most advantageous option is if the acting head executes his work without exempting him from performing the work on the basic position, that is, internal compatibility will be formalized. This option is more common, since Article 151 of the LC RF establishes in this case unlimited terms for the performance of duties, whereas with full replacement in office such execution is possible for not more than one month. This is beneficial for educators, since the duration of their leave is at least 36 working days.

For the person in the post of deputy head of the kindergarten there are no such problems. As a rule, he has a qualification category as a manager, and in his functional duties there is a line stating that during the holiday of the head it is he who is acting, with all the rights and duties of his boss. He may be suspended for the same period from carrying out his immediate duties in educational work.

If, on the other hand, the deputy head works in a pre-school institution on a part-time basis, then in order to take up the position of the head, he must take leave on the main place of work for the same period (Article 347 of the LC RF). Restrictions in its activities are defined by Art. 345 TC, which regulates the work of part-time workers who work only half the time for the specified position. Thus, a part-time worker is an employee who only half- fulfills the duties of a manager.

If, for some reason, the deputies were unable to perform the work of the manager during his vacation, then the acting director is appointed by the founder from among the internal employees who have experience in this position, or for that period a person from outside is accepted. These workers do not have the right to sign documents of a material nature, unless a separate power of attorney from the head of the institution has been drawn up. In the absence of such power of attorney, but the need to conclude a contract, the acting director has the right to notify the absent employee of the transaction. The same, in turn, must appear at the appointed time for signing documents to his workplace.

The acting head of the office during the absence of the head has the opportunity to demonstrate to the founder his management potential, which can be an incentive and reason for giving him a vacant position as head of another preschool institution.
