A Rescript is a law or a document?

What is rescript? Today this term, mentioned in all known explanatory dictionaries, has several meanings. Under the word of Latin origin can be understood as an act of rewriting the document, and the result of this action; As a decree or official announcement, as well as a written response of the Roman emperor to a magistrate's question about the peculiarities of the interpretation of a particular law. In the historical spectrum, a rescript is also a written interpretation of the discipline or doctrine given by the pope or other religious figure with sufficient authority.

The essence of the document

Everyone can ask a question or express their doubts about the correct understanding of biblical texts. Moreover, a rescript is a paper that can contain not only the interpretation of sacred books, but also the pope's answers to queries or petitions of the administrative plan. Sometimes such documents give permission for any legal action. In some cases, their writing and publishing is equated with the administration of justice. A petition sent to Rome must consist of three parts:

• Narrative of the situation or simply a listing of facts;
• Directly request;
• Justification of the reasons for applying this request to the head of the church.

Rescript is a serious official document, and therefore the answer to it is also always structured and consists of similar fragments: a brief statement of the case, permission, justification of the conclusion accepted by the pope.

Features

In each case, it is presumed that in the request of the person of interest the true truth is stated. An untruthful lie or concealing the truth deprives the document of legal force, because in accordance with the divine commandments one should not take advantage of fraudulent means.

A Rescript is a decision of the Pope adopted in accordance with the laws, and therefore it has the force of a legal act with respect to the person (petitioner) involved. If the contents of the document somehow contradict the law, it contains the corresponding item: "Despite all the contradictory circumstances." The text always has a strictly direct meaning, and the instructions of the pope are compulsory.
