What will happen if you go without insurance. How many days can I go without insurance?

The current legislation for driving a vehicle requires the driver to have an OSAGO insurance policy. And the drivers themselves must ensure that everything is in order with the document. This kind of insurance is a contract signed by the parties, one of which is the company issuing the policy, and the other is the owner of the car. In this case, he is guaranteed compensation for damage if an accident occurs. In addition to OSAGO, there is insurance and voluntary nature. It is called CASCO, and also DSAGO. In this article we will try to answer the question: what will happen if you go without insurance? The implication is, of course, the policy of OSAGO, and not other contracts that can be concluded or not concluded at will.

What happens if you go without insurance?

Russian law requires a driver not only to purchase a compulsory insurance policy, but also to keep it with him while driving. Riding without a document is fraught with an offensive for which administrative responsibility is foreseen. Until 2009, drivers could drive a small period of time and without it in the event that the previous policy only ended. However, this order was later abolished. And since then to ride a car without insurance is strictly prohibited. The document must be issued even if the driver drives the vehicle by proxy.

If a traffic police officer stops the car and demands to show documents, he does not see the valid policy of OSAGO among other documents, then the car owner is fined. On the other hand, he does not expect much good in case of getting into a traffic accident. The driver will not only have to repair the car at his own expense, but also reimburse the costs of repairing the vehicle of another participant in the accident, if it is the culprit. And if there are also victims, then the entire burden of payment for the treatment will also fall on his shoulders. But the penalty for driving without the rights of the culprit will also not be avoided.

If the policy is left at home ...

Sadly, but in this case, the penalty will still have to pay. However, all the same, the legislator stipulates that such a situation is possible. In accordance with this, the amount of penalty in one case is different from the other. For the inspector, however, this issue is not fundamental. Therefore, he usually writes out the maximum penalty. If the driver does not agree with this decision, he should try to convince the policeman that the contract does exist. You can ask relatives or friends to bring the policy to the post of the DPS or to go home for the ride yourself. After all, one way or another, it will be needed for further driving. There is another option. Prove the availability of the policy can be via the Internet, especially if it was formalized electronic OSAGO.

Electronic OSAGO

This type of service appeared in Russia more recently. Some drivers have already used the convenient service. Others prefer to buy insurance "in the old fashion", driving up to the office and getting a paper document. Of course, electronic OSAGO has a number of advantages over the acquisition in the usual way. Firstly, you can order the policy at any time convenient for you, having spent only 7-10 minutes of time. Do not have to get out of work and go somewhere, stand in line to get a document.

Secondly, probably, there is no driver who would not come across obsessive offers of insurance agents for the acquisition of additional services. Many, not much thinking, agree to everything that they offer. And then they regret the choice. But when making an order through the Internet, such a problem does not arise. The car owner chooses the services that seem to him optimal.

However, there are some disadvantages of electronic compulsory motor TPL insurance. In particular, this concerns the fact that the online server is not yet well served. Thus, during peak hours for orders over the Internet, it can hang. And all entered data will have to be entered again and again. Let's hope that this problem will be solved in the future. Meanwhile, we return to the question of what will happen if we go without insurance. Having understood that responsibility in its absence can not be avoided, we see that in the presence of electronic OSAGO there is still some advantage.

Electronic MTPL and Inspector of the State Traffic Safety Inspectorate

When ordering it, the driver receives a letter with an attached policy via e-mail. Having on his phone access to the Internet, he can go into the mail and show the inspector the policy in electronic form. Of course, this will not cancel his duty to pay a fine. But the amount will be a little less.

What else can you do to pay less?

If the inspector of the DPS does not agree with any arguments, and it's impossible to go home or get relatives through the relatives, that is, there are still options how to get out of the situation with the least losses:

  1. In the protocol, which is filled in by the traffic police officer, there is a point where the driver can write his opinion about the illegality of the fine. And to specify there the real reason.
  2. Within 10 days the car owner has the right to appeal a fine, referring to the superiors of the employee who drafted the report. Often it works.
  3. There is another option to go to court. However, it is unlikely that there will be a driver who would decide to sue because of such a small fine. Usually, having paid for it, the fact is forgotten. But it would be good if it would teach in the future always to have an OSAGO document in paper form with you.

Is it possible to travel by car without insurance and what will happen for it?

As we already know, if the insurance is overdue, the use of the vehicle is prohibited. Until recently, until 2009, the operation of the vehicle was allowed, when the policy term expired. Drivers and then asked themselves the question: how many days can I go without insurance? For a whole month the chauffeur could not worry that he would have to pay a fine if the traffic police officer stopped him. Now the situation has radically changed. And there is a definitive answer to the question of how much you can ride without insurance. Under the contract of OSAGO, even if it has only expired a couple of hours ago, it is impossible to operate the vehicle. The driver in this case is waiting for a fine.

What is fine?

Currently, there are two administrative penalties:

  • 800 rubles. The driver pays them for driving without a formal policy.
  • 500 rubles. The money is paid for the absence of compulsory motor TPL insurance, or for not signing into the contract of the driver, who at the time of stopping by the inspector of the State Traffic Safety Inspectorate ran the vehicle.

If the driver is not inscribed in the policy of OSAGO?

Let us discuss this point in more detail. Motor third party liability insurance can only be allowed to be used by drivers who are inscribed in the contract, or all without restriction. The second option is much more expensive for an automobile owner. Therefore, most often choose the first. According to him, only those persons who are registered in the contract can drive the car. Therefore, if someone is driving a car not listed in the document, you will have to pay a fine. And the culprit in this case is the car owner, not the driver.

Usually the contract of OSAGO is concluded for a period of one year. But, for some car owners this is uncomfortable. Some people leave for a long business trip, others use the car only in a certain season (for example, summer residents). For them, of course, it is better, if it was possible to travel without insurance. Under the contract, however, it is possible to provide for another period. For example, six months or three months. However, in this case, the policy will be much more expensive. At the same time, there are exceptional cases when the car can be operated without insurance.

  1. If the vehicle was purchased recently. How much can you go without insurance in this case? The law refers to a period of 10 days.
  2. When entering into the inheritance.
  3. In other cases provided for by law.

Conclusion

What happens if you go without insurance? We have already understood that in this case the employee of the DPS will be fined if he stops the car. And the amount of recovery depends on the contract concluded at the time of OSAGO or its absence as such. Also, it is now clear what to do if the policy is left at home, but the inspector refuses to believe it.

It should be added that the fine is the only thing that a traffic police officer can punish a negligent driver. Until recently, until 2014, for such a violation could remove state numbers, and send the car to the parking lot. However, this rule was decided to be abolished. And the maximum that a driver can expect today is a fine of 800 rubles.
