What is the company's energy passport?

In accordance with the legislation of the Russian Federation, many business entities must compile energy passports. What are they? What is the specificity of the development of these documents?

What is the purpose of the energy passport?

The company's energy passport is a document that is compiled by competent experts following an energy audit of a facility used in business. In accordance with the requirements of federal legislation, it should include information:

- about the level of the facility's equipping with devices, through which the consumed energy resources are recorded;

- the number of energy resources used, as well as the dynamics of their consumption;

- on the indicators that characterize the energy efficiency of the facility;

- on the size of energy losses - if the organization is engaged in their transfer;

- on the potential for implementing energy conservation measures;

- on typical activities aimed at optimizing energy conservation.

The document in question is usually drawn up for facilities forming industrial infrastructure, administrative, as well as residential buildings. The energy passport reflects the balance of energy resources consumed by the organization, and also records information about the performance of this infrastructure. In addition, the energy certificate of the enterprise can contain information on the plan of measures aimed at optimizing the energy efficiency of the relevant economic entity.

For whom is it necessary to compile an energy passport?

The legislation of Russia identifies lists of persons for whom the compilation of the document in question is mandatory for the reason that they must undergo an energy audit. While the energy certificate of the enterprise, as we noted above, is a source that is compiled on the basis of an appropriate audit.

The preparation of this document is compulsory:

- for authorities;

- for legal entities that are established with the participation of the authority;

- for organizations that carry out activities related to regulated;

- for legal entities that produce or transport water, gas, electricity, heat, extract gas, oil, coal, produce petroleum products and process the relevant minerals;

- for companies whose expenses for energy consumption exceed the values established by law;

- for organizations that implement activities aimed at optimizing energy efficiency and financed from the budget.

Periodicity of issuing energy certificates

These categories of persons should conduct energy audits at least once every 5 years. Based on the results of each event, an energy passport of the enterprise is compiled. Thus, the validity of the document in question is 5 years. At the same time it is formalized for a legal entity as a whole, and not for individual objects.

Sanctions for the lack of an energy passport

If the energy audit is not carried out by the organization that is obliged to carry out this procedure by law, and, accordingly, the energy passport will not be received by the firm, it can be fined. The amount of sanctions in this case is determined by the status of the person who committed the offense in the form of failure to perform the corresponding audit.

It can be noted that the need to compile the document in question can be established not only by Russian legislation, but also by legal acts of other states. For example, such a document is provided by Ukrainian legislation.

The procedure for developing an energy passport

So, now we know why the company needs an energy passport. We will study the order in which the development of the document under consideration.

First of all, the company's management needs to find out whether the company's energy passport is necessary for the business based on the requirements established by law.

The next step is to find an energy auditor and conclude an agreement with him. Thus, the next step in the development of this source is direct work with the energy audit facility. It is also carried out in several stages.

First of all, the competent specialists of the partner organization collect information on the energy audit facility. Then, the data is processed and analyzed. After the inspection, as well as an instrumental inspection of the energy audit facility. Development of energy passport: nuances

The main Russian source of law, according to which the company's energy passport is being compiled - Order of the Ministry of Energy of Russia No. 400, adopted on June 30, 2014. In this normative act it is said that the document under consideration is compiled using the information that is reflected in the report, which is formed, as in the case of a passport, following the results of an energy audit of an object. At the same time, the date of this report should coincide with the date of the audit, as well as the formation of the document in question.

What specific information should include the company's energy certificate? The law determines their specific list. Let's study this nuance in more detail.

What should be contained in the energy passport?

The structure of the document in question should include:

- the title page, which is desirable to be drawn up using the form given in Appendix No. 1 to the Requirements for the preparation of an energy passport, approved by the Ministry of Energy Order No. 400;

- general information about the energy audit facility using the form according to Appendix No. 2 to the Requirements;

- information on the level of the equipment of the enterprise with the instruments of registration - in the form that is given in Appendix No. 3;

- information on the amount of energy resources used - using the forms given in Appendices No. 4-13;

- data on indicators that characterize the energy efficiency of facilities - in accordance with the form approved in Appendix No. 14;

- information on the amount of energy losses transferred by the enterprise, as well as recommendations aimed at reducing them - according to the forms given in Appendices No. 15-20;

- information on the potential for implementing measures aimed at energy saving, as well as on assessing the prospects for saving energy resources - in the form given in Appendix No. 21;

- data on activities aimed at optimizing energy efficiency - according to Appendix No. 22;

- information on the staffing of certain activities that are aimed at optimizing the energy efficiency of the enterprise - according to the forms given in Appendices No. 23-24;

- data on the amount of energy resources for enterprises that produce, store or process gas - according to the forms given in Appendices No. 25-29;

- data on the amount of energy resources used - provided by gas transport enterprises, according to annexes No. 30-34.

How can the company's energy certificate look like? The sample document is on the picture below.

It is important that the document conforms to the norms introduced by the Ministry of Energy Order No. 400. This source of law provides for a number of nuances that characterize the filling of the energy passport directly. Consider them.

Filling out an energy passport: nuances

The first thing that should be paid attention to the enterprise that makes up the energy passport is the fact that if the company has separate subdivisions in other municipalities, the document in question should be supplemented with information using Annexes 1-34 for each division. This, of course, adds work to the responsible managers of the company, especially taking into account the fact that the validity of the company's energy passport is limited - it needs to be changed every 5 years, while opening a branch in the company's ownership may result in a large number of new objects.

The following nuance: if any information on the energy audit can not be specified by the firm because of their absence or the inability to measure certain indicators, the field provided for reflecting the corresponding values is not filled, unless otherwise expressly provided for by Requirements approved by Order No. 400.

In the event that the information for reflection in the Annexes to the Requirement is not in principle, they may not be attached to the energy passport of the enterprise.

Sending a copy of the passport to the Ministry of Energy

So, we have studied what is the energy passport of the enterprise, why it is needed. Let's consider one more nuance of the legal relations characterizing the application of this document - sending its copy to the Ministry of Energy. These communications are also regulated by Order No. 400. This source of law prescribes the dispatch of copies of energy passports to the self-regulating organizations - SROs engaged in activities in the field of energy inspection at the Ministry of Energy.

Copy of the passport for the Ministry of Energy: nuances

The procedure should be carried out not less than once in 3 months. A copy of the passport must be paper and electronic - in PDF and XML formats, which is attached to the main document on disk or on the Internet. In addition, each copy of the energy passport must be sent to the Ministry of Energy together with a cover letter, which indicates information about the self-regulatory organization - also in paper and electronic (PDF format) versions. Paper versions of documents sent to the department must be certified by the signature of the head of the firm, as well as the seal of the organization. If the documents are electronic, they must be certified with an electronic signature.

The Ministry of Energy, having received from SRO the energy passport of the enterprise, which is represented by paper or electronic copy, must process the relevant document within 30 days. The Office examines the sources received for compliance with their structure and content with the provisions of Order No. 400, as well as with the requirements of the legislation of the Russian Federation regulating the procedure for the implementation by individuals of measures aimed at optimizing energy efficiency.

Registration of a copy of the passport in the Ministry of Energy

If copies of the energy passport are sent by the self-regulating organization to the Ministry of Energy with violations, or if the relevant documents do not comply with the requirements of the legislation of the Russian Federation, the agency will send a self-motivated refusal to register these sources.

If everything is in order with the documents, the Ministry of Energy will send a notice to the SRO about the registration of the relevant copies. In this case, this source is sent to the SRO both in paper and electronic versions. Documents that are available to the Ministry of Energy in electronic form are placed on the personal account of the SRO in a specialized state information system.
