How to find out the debt of bailiffs?

Every man has got into debt at least once in his life. If the sums are small, then they can somehow be remembered. But when money needs to be returned to several instances at once, confusion may begin. If you do not repay the debt on time, then at the most unexpected moment it can come out sideways. For example, during check-in for a flight, it turns out that the bank wrote a claim on you and won the process. How to find out the debt of bailiffs?

Who can not be allowed to go abroad?

In Art. 67 of the Law "On Enforcement Proceedings" it is said that persons who have debts on alimony, loans, taxes, fines, payments for housing and communal services that without valid reasons have overdue the repayment period can be entered in the FSSP database. Based on these data, they will be limited to leaving the Russian Federation. In this case, a separate court decision is not required. For IP, the tax service's decision to collect debt is in itself an executive document. On its basis, information can be entered in the FSSP database. Moreover, any administrative violations can be the basis for initiating enforcement proceedings : non-return of money to the tax, traffic police, border, veterinary, customs, labor inspection. Any fine must be paid within 30 days from the date of entry into force (Article 32.2 of the Code of Administrative Offenses). Then it is necessary to present documents confirming the fact of payment to the body that issued the resolution. If this was not done, all materials will be sent to the bailiff. Restrictions

After issuing the resolution, the debtor has five days for voluntary repayment of the debt. This right is written in the document itself. If the debt is not repaid voluntarily, then the offender has no right to leave the country. But if measures are taken to enforce debt, then such a ban is not always legal.

Example

The amount does not matter

The legislation on this issue does not specify any restrictions. Even a penny debt can be the basis for depositing the debtor in the "black list". But the tax authorities rarely apply to the writ of execution, if the amount does not exceed 1500 rubles. The costs of processing documents may not pay off. But there were cases when the control system allowed people with debts of several thousand rubles to leave the country. Failures happen, but rarely.

The Federal Law does not specify a time limit for the ban. Order No. 36 of the FSSP Moscow Office states that it can not exceed 6 months. And then what? If the debt is not repaid, it is possible that the relevant authority will apply for a second ruling. Therefore, it is worth to know in advance the debts of the bailiffs and pay off their debts.

How the prohibition mechanism works

After execution of the decision, the bailiff must send it to the debtor, as well as to the Migration Service. The latter adds the data to the list of "non-banned". If such a person does not have a passport, then it will not be possible to receive it until the debt is repaid. If there is a document, a request for its seizure is sent for the duration of the ban. Independently do this bailiff has no right. In practice, passports are seized extremely rarely. And if the document was not taken away from the debtor, then the court may not recognize the ban on the lawful act.

Apply to the Federal Bailiff Service (FSSP). Their branches are located practically in every city of the Russian Federation. But to get the information you need, you'll have to visit the office at the reception. At the same time, there is a possibility that on the day of the application you will not receive all the necessary information. If the queue is big, and you come for lunch, you may not have time to see a specialist. Those who nevertheless decided to personally visit the FSSP branch, it must be remembered that throughout the Russian Federation this structure takes citizens on Tuesdays (from 8:00 to 16:00) and Thursdays (from 16:00 to 19:00).

If there is no desire to stand in line, then it is possible to find out the indebtedness of bailiffs on the same site of the organization. It works round the clock. The list of debtors is of a truncated nature. There are no data on the amount and recoverers in the database, but you can check the presence of the subject in the lists. According to the bailiffs themselves, every defaulter should know about his debts. Housing and communal services and banks do not immediately go to court. Strict measures are taken only against malicious defaulters.

On the main page of the site in the lower left corner there is a button "Find out about your debts". After clicking it, a page with information about the data bank opens. At the bottom is a form for filling. At the first stage, you must select the direction of the search. Only individuals can find out the debts of bailiffs by their last name. To do this, the site will need to specify the place of residence, name, birth date. Yurlitsa should indicate in the form of a territorial registration authority, the name of the enterprise, the address of the state registration. To find out the debts of bailiffs of the Krasnoyarsk Territory, for example, or any other region of the Russian Federation for an open case, you need to select the item "Search by IP number". As a result, a table with a list of debts is displayed. Directly from the site you can pay off the debt. To do this, click the "Pay" button in the "Service" line. The system provides for several options for debt repayment: Promsvyazbank accepts Visa, Mastercard, Qiwi, Webmoney, Oplatagosuslug.ru. After payment, the information in the database is updated automatically. When you re-visit the site on the page, the message "Nothing found on your request" appears.

Variants of development of events

After the repayment of the debt, it is necessary to present to the bailiff a package of documents confirming the fact of payment. On their basis, a decision is made to abolish the restriction. This document is sent to the territorial office of the FSSP. There, these data are entered in the register. Copies of documents are sent to the migration service and to the debtor. All services receive notifications once a week. Therefore, in order to exclude oneself from the "black list", it is necessary to do debt repayment at least three weeks before the preliminary departure date.

With any administrative violations you can get to the base of "restricted people". In this case, a person can not even guess about it. The executive list is issued by the bailiff. You can find out the debt in two ways: to visit the FSSP office and sit in the queue or go to the organization's website of the same name and view all the data there.
