Long-term work experience, as you know, is the guarantor of a good pension. To correctly calculate its volume for obtaining pensions or calculating payments on a sick-list, it is not enough just to operate on records from the workbook. We consider here periods for calculating the length of service, we will understand its structure and give concrete examples.

What is work experience

The legislation of our country determines the length of service as the total time of labor and / or socially useful employment of an individual citizen. All information about her is entered in the personal work book. It is the work experience in our country that is the basis for the provision of:

  • Wages;
  • Holidays;
  • Pension provision;
  • Temporary disability benefits.

The total work experience in the Russian Federation is divided into labor (now insurance) and special. Let us analyze these concepts in detail.

From general labor to insurance experience

The total length of service is the entire duration of labor, socially necessary activities of a person, as well as other periods included in it under the law. Since the entry into force of FZ-173 "On labor pensions" on 01.01.2002, this concept was replaced by insurance experience. It is interpreted as follows: the total duration of the citizen's activity, during which contributions were paid to the Russian Pension Fund, as well as other periods stipulated in the legislation.

It is the insurance guard that is taken into account when calculating a pension - in order to get the right to it, you must pay insurance contributions for a total of five years. The Russian pension system today is based on the principles of insurance - the size of future pension payments is affected not by the amount of earnings, not the length of service, but only premiums deducted by a citizen to the Pension Fund.

To calculate the length of insurance, we need to first of all know what the law includes in it.

What is included in the work (insurance) experience

P. 1 of Art. 10 FZ "On labor pensions" primarily includes in the length of insurance:

  • Employment or other activities in the territory of the Russian Federation, produced by citizens who have been insured, according to the legislation on compulsory pension insurance.
  • Employment or other activities of citizens outside the territory of the Russian Federation, if, according to Russian legislation or international treaties, it is permissible to make it into the general work experience of a citizen. Otherwise, in order to include the period of such work in his experience, a citizen must, in its duration, pay the necessary amount of insurance contributions to the FIU.

What is also included in the work experience

To calculate the length of the FZ "On Labor Pensions" also allows the use of the following periods:

  • Military service, work in the internal affairs agencies, the criminal executive structure, the fire service.
  • Time of receiving benefits during periods of temporary incapacity for work.
  • Training in the daytime department in the middle or higher professional educational institution.
  • Work as a lawyer, private detective, security guard, notary.
  • The period of membership in a production cooperative, collective farm or other farm or peasant farm.
  • The time for caring for a child before reaching the last 1.5 years. With the reservation - no more than 6 years in total, i.e., the time of leaving only for four children.
  • Period of receiving unemployment benefits.
  • Time of participation in paid social work.
  • The duration of the move for the purpose of employment in another locality in the direction of the civil service.
  • Paid work of the condemned.
  • The period of detention, serving a sentence, being in exile in the event of an erroneous charge.
  • Execution of the powers of a deputy of the State Duma, a member of the Federation Council.
  • The time for leaving an able-bodied citizen for a disabled person of the first category, a disabled child or an elderly person is over 80 years old.
  • Care of a child infected with HIV and AIDS before reaching the age of 18.
  • Time of entry into the tribal community of the small nationalities of the Far North.
  • The period of work in the areas that were not previously taken into account in the work book - IP, the contracted employment of "home" workers - a nanny, a housekeeper, a personal secretary.

It is worth noting that these periods are taken into account in calculating the length of service only if they were preceded or followed by labor or other activities accompanied by payment of insurance premiums to the FIU. If two or more of these periods coincide with each other in time (receiving unemployment benefits and caring for the elderly person, for example), then only one of them is counted in the insurance record at the choice of the citizen.

Documents required for calculations

Traditionally, the calculation of length of service in the work book. If this document is lost, contains incomplete or incorrect information, then the law is also permissible to use:

  • Labor contracts, drawn up for all the requirements of the current legislation at the time of the conclusion of the legislation;
  • personal accounts;
  • References issued by the employer's hand;
  • Statements for the issue of salary;
  • Extracts from orders.

To the listed documents, the general requirements are the contents of the following information:

  • Number and date of issue;
  • Name, birth date of the worker;
  • Position, period, place of employment;
  • Weighty grounds for delivery.

You can also confirm your insurance experience by extracts confirming the transfer by you or your employer of insurance contributions to the Pension Fund in the required period.

Rules for calculating the length of service

The record is calculated according to a simple scheme:

  1. According to Federal Law No. 255, art. 16, item 1 to determine the periods of their activities, which are part of the insurance period.
  2. Translate the duration of each period in calendar days.
  3. Summarize all periods, resulting in the total number of calendar days.
  4. From the resulting number, allocate the full months (= 30 days).
  5. From months to allocate the full years of experience (= 12 months).
  6. Get the total length of service in years, months and days.

There is another version of the rules for calculating the length of insurance. The duration of the activity is considered from the day of its beginning to the day of termination inclusive (that is, one day is added additionally). For example, from the day the work begins to the day of dismissal. First you need to add up the years, then months, and then days. Then, if necessary, translate days into months, and months into years, given that 1 month = 30 days, and 1 year = 12 months.

Example of calculating the length of service

Here is an example of calculating the length of service. The citizen has marks in the work book:

  • Employment in the enterprise "Orion": 5.02.1980 - 7.06.1995.
  • Employment at the plant "Altair": 10.07.1995 - 22.07.2012 y.
  • Employment in the cooperative "Sunny": 15.09.2012 - 20.12.2016.

We consider his work experience for the periods:

  • "Orion": 15 years 4 months 3 days (since the day of dismissal is considered to be included in the length of service).
  • "Altair": 17 years and 13 days.
  • "Sunny": 4 years 3 months 6 days.

As a result: 36 years 7 months 22 days.

Regulations on special seniority

FZ "On State Pensions" in 1990 determined the special work experience as the total duration of activity in certain spheres of the national economy or areas of public activity. He assumed both the receipt of pension payments for the length of service, and the preferential procedure for calculating the length of service. Modern legislation, however, diminished the importance of special length of service, leaving, however, its key advantages.

Special working experience today is taken into account when assigning a pension:

  • For long service: working in special working conditions, employed in medicine, civil aviation, pedagogy, creative activity, military and public service.
  • Employed in underground work, in hot shops, working in workplaces with harmful working conditions.
  • Due to old age due to special conditions of work activity - I, II group who received disability as a result of occupational disease.

Inclusion of a particular employment in a special period of service is regulated by the following acts (with the relevant amendments and additions):

  • ФЗ №76.
  • FZ number 10.
  • Law No. 3061-I of June 18, 1992
  • Resolution of the SM of the RSFSR No. 384.
  • Decisions of the Ministry of Labor of the Russian Federation No. 29.

Counting the length of service for the sick-list

To make these calculations, you need information about the insurance period - the periods when the employee was insured for a temporary disability. Recall that in this length of service, under the law, is:

  • Official employment under an employment contract;
  • State or municipal service;
  • Individual entrepreneurial activity, membership in the collective farm, activities in the ROC, periods of deputieship in the State Duma;
  • Military service, work in law enforcement agencies, etc.

Thus, you need to summarize in the calendar order all the above periods - the last term will be the day of loss of temporary incapacity for work. When calculating the length of service for the hospital, it is important to pay attention to the fact that it includes full years and full months of your activity. "Remains" (months and years that have not been fully worked out) need to be translated into days, and then to form months (= 30 days) and years (= 12 months) and add to "full" experience - as well as for general calculation .

After calculating the length of service, you can judge the amount of payments for temporary incapacity for work:

  • Less than 6 months - 1 minimum monthly salary / month.
  • Up to 5 years - 60% of your average salary.
  • 5-8 years - 80% of the average salary.
  • More than 8 years - the sick leave will be equal to your average salary.

The length of service, namely - contributions to his duration contributions to the FIU are the guarantor of receiving a pension, payments for temporary incapacity for work.
