The Penitentiary Inspectorate. Day of Penitentiary Inspection
Practically in any legal state there are executive bodies called to implement punishments prescribed in court. In the Russian Federation, these functions are performed by the penitentiary inspectorate. The specialized body also controls the conditionally released persons and people who have served time in places of deprivation of liberty.
Legal basis
The main goal of the Ministry of Internal Affairs of Russia is to prevent the commission of crimes. For this purpose specialized agencies (penal executive inspections) are created in the state. They execute sentences against convicted persons, excluding their isolation from society.
- Regulation of the rule of law, conditions for the execution of sentences;
- Determination of ways to correct convicts;
- Protection of the rights, interests and freedoms of persons serving a well-deserved punishment;
- Assistance to convicts in the issue of their social adaptation.
The above tasks and goals are spelled out in the Penal Enforcement Code (abbreviated PEC) of the Russian Federation. This is the main document in the spheres of criminal and executive legislation.
Bodies executing punishment
In the 30-ies of the last century, institutions that carried out sentences imposed on convicted persons without isolating them from society were included in the system of the Ministry of Internal Affairs of the USSR. Activities of penitentiary inspectorates (Abbreviated UII) until 1999 was also determined and controlled by the Ministry of the Interior. Such institutions were independent structural units; In them worked the police. In early 1999, under the presidential decree, the criminal executive system was transferred to the jurisdiction of the Ministry of Justice of Russia. Such a reform was justified by the desire of the Russian Federation to become an equal member of the international community. Today, the Russian Penitentiary Inspectorate is a multi-functional institution that combines the functions of executing punishments and using criminal law measures. Its activities are aimed at preventing possible offenses in the future.
Penitentiary system: structure
The UIS of the Russian Federation has traditionally included bodies, correctional institutions that carried out criminal penalties imposed on convicted persons. But along with them, there were other services that were responsible for the implementation of criminal law measures, not related to deprivation of liberty. The current legislative acts determine the structural parts of the penitentiary system of the Russian Federation. It includes:
- Institutions that execute punishment;
- Territorial authorities;
- Federal bodies authorized in the enforcement of sentences.
According to the decision of the Russian government, the criminal-executive system may have additional components: investigative isolators, medical, design, educational and other institutions. In the legislative acts of the Russian Federation there are prescribed services designed to carry out criminal penalties. This includes the criminal executive inspection, which carries out punishment without isolating convicted persons from society.

UII tasks
- Execution of the established penalties in the form of organization of compulsory work, deprivation of the opportunity to occupy certain positions, carry out specific activities.
- Control of the conditionally convicted persons, who have served their sentence in a suspended form.
- Measures to prevent violations of persons who are registered in the MIS.
Work in the penitentiary inspection has some features. This service is designed to carry out punishment without isolating persons from society, to control previously convicted people and to prevent the commission of an offense in the future. At the same time, UII employees must act strictly in accordance with the acts, orders, instructions of the Ministry of Justice, the Federal Penitentiary Service of the Russian Federation (reduction of the FSIN).
Principle of operation
The Office of the Penitentiary Inspectorate - FSIN for a specific area. It monitors the activities of bodies that carry out the established punishment. Employees of the inspection of the UII daily face an increasing problem - the number of drinkers increases. More and more crimes people commit, being in the strongest alcoholic intoxication. And in a sober way they do not even understand how they could decide on such an act. Therefore, the main task of the UII employees is to carry out systematic monitoring of such persons, in particular, to assess their mental state. Specialists of the inspection admit that with such people it is necessary to be able to find a common language, and not demonstrate their power over them. In addition, the employees of the UII supervise convicted persons who are exempt from compulsory serving of punishment. The main task of state bodies in this case is to help people who have committed a crime before, in the matter of their social adaptation.
Control of convicts
The Criminal Executive Inspection is an official body charged with monitoring the convicted persons who have been released from punishment. For this purpose, educational work is carried out with them , planned by the executive committees. They are organized at the place of work, study or residence of the released person under the supervision of the supervisory commission. Educational processes are carried out by public organizations (often labor collectives). Convicts released from punishment for serious crimes are supervised by the representatives of the penitentiary inspection, which supervises them for preventive purposes. UII also supervise conditionally released persons ahead of schedule during the term of punishment that they have not served. This procedure is carried out at the place of residence of convicts.
Preventive supervision
The Russian PECs require the authorized bodies to carry out preventive supervision of released persons who have served their sentences in places of deprivation of liberty. Such procedure is carried out by the criminal executive inspection to prevent future crimes from these persons and to provide them with the necessary preventive support. At the same time, preventive supervision is conducted without degrading the dignity of previously convicted persons. Legislation establishes a certain procedure for performing this procedure:
- The court ruling on the implementation of preventive supervision is sent to the department of the UII at the place of residence of persons who have served time in places of deprivation of liberty.
- Employees of the inspection warn the discharged person of responsibility for non-compliance with the requirements of the preventive supervision established in relation to him and the consequences of avoiding this procedure.
- If the supervised person does not stay in the chosen place of residence at the appointed time, the UII declares him wanted.
The employees of the penitentiary inspectorate are obliged to carry out systematic monitoring of persons subject to preventive supervision.
Means of supervision and control
Every day of the penitentiary inspectorate begins with the control of convicted (released) persons. In their work, UII employees use electronic methods of supervision and control. These include technical means used by government agencies to monitor home arrest; In cases of the imposition of punishment in the form of deprivation of liberty. Monitoring in the electronic form of controlled entities implies the use of the following equipment:
- Stationary monitoring devices (DCS);
- Mobile control devices (MKU);
- Electronic bracelet - EB.
DCS is used for continuous 24-hour monitoring of the presence of certain persons in the designated territory. The device also signals if the controlled one tries to get rid of the electronic bracelet. MKU is an electronic device that must be worn with EB. It allows you to track the location of the convicted person by the GPS or GLONAS satellite system.
Day of Penitentiary Inspection
Effective use of punishments, which are an alternative to imprisonment, in relation to persons who commit crimes of moderate severity, help protect the society from the perpetrator and reduce the level of public criminalization. For effective control, UII employees use audiovisual, electronic, technical means of monitoring convicts. In practice, programs for psychological personal correction are being introduced. Work in the UII is responsible, requires attention, involves risk. Every year on May 7, the Day of Penitentiary Inspection is celebrated in the Russian Federation. This is a holiday of the UII employees. The penitentiary system is constantly evolving and improving. In her work she interacts with the services of the Ministry of the Interior of the Russian Federation, the bailiffs' departments and other security agencies. The activity of the UII is also supported by the heads of the districts, the administration of municipalities.
