Leave of civil servants. Changes in the Federal Law

Legislation is regularly improved. People who are affected by the changes need to be aware of, so as not to violate regulations. So, now the vacation of civil servants becomes less prolonged. In June 2016, the legislator revised the old norms. Let's see what the length of public service leave will be now, whether it is very different from the rest time of other employees.

The text of the law is not very large. It indicates the changes made to certain articles 79 of the Federal Law. All of them concern the duration of the main and additional holidays. So, if earlier the first depended on the post, now all state employees will rest on the same number of days - thirty. The next change concerns the duration of additional holidays. There are two types. The first - for long service, the second - for an irregular day. Norms relating to both, significantly redesigned. That is, from the moment the law comes into force, the people of the state will rest less than before. Is this fair? The legislator is more visible, the solution of such questions is within his competence. And the employees themselves had to choose: to fulfill new norms or to look for another job. Why is this decision made?

Grounds for adoption of 176 FZ

When discussing this legislative act, the following reasons were indicated:

  1. The need to save budget funds.
  2. Injustice of existing norms.

In the previous edition, the duration of the holiday provided for irregular work was established by the organization. That is, it was possible to abuse this norm. Legislatively it was stipulated that the additional leave for state employees in this case could not be less than three days. In fact, the organization could establish it in any size. And this was reflected in the financing. After all, these kinds of holidays are paid from the budget. For the same reason, the procedure for calculating additional leave for length of service was changed. He also significantly decreased. The latter circumstance is especially sensitive for "old" workers, but it is not at all important for young specialists who have not yet risen to the benefits. The law will save serious budget money.

New standards

According to the changes introduced, civil servants leave now makes thirty calendar days. No gradations and accounting for "big ranks", as before, the law does not assume. All people are sovereign, regardless of rank, are equal in terms of the duration of paid leave. If you do not remember, the old version had 30 and 35 days. Additional rest time has changed a little differently. In the old version of the normative act it was assumed that for one year of service the employee received one additional day of rest. This led to the fact that some people were absent from service for two months, if not more. And if you take into account also the second grace holiday, then to wait for such an "employee" in his place was a difficult matter. Now the standards have been standardized (see table).

For example, let's see how the rest of people who have served in government bodies for a long time changed. If earlier a person with eight years of experience had the right to the same number of additional days, now his rest is limited to five. Savings - wages for three days.

How has the vacation changed for irregular day

Even stricter the legislator approached this norm. Previously, it was installed by the company. The law limited only its minimum duration. By agreement, it was possible to appoint any timeframe, if only there was enough money to pay. Agree, there is little or no rationality in this expenditure. Now it is established that this type of preferential rest is limited to only three days. Strictly and concretely. Any amateur performance in this matter is excluded. Probably, some people do not like such austerity. But we need to understand, there is not enough money in the country, they should be saved.

Additional provisions

There was one important question left. Not all people of the state have the opportunity to go on vacation on objective circumstances. Some people accumulate uncontrolled periods. According to the provisions of the law, the leave of a civil servant falling under the old version does not change retroactively. This means that those periods that are calculated before the entry into force of the new rules remain the same. The person was supposed to be thirty-five days of the main and fifteen plus ten additional - so much and take time off. And still employees have the right to take money (compensation is called). All this is calculated according to the old legislation.

Conclusion

It remains to note that the rules came into force on August 2, 2016. Changes in the legislation have upset not only state employees, they have also added jobs to specialists in human resources departments. One thing is good, that a new edition for each individual person begins to work with his personal new year. That is, if he got a job on April 9, then vacation for 2016 is going up according to the old law. And those who came on August 3 will receive short rest periods. All other changes will affect from 2017. Note that the legislator has significantly curtailed the leave of civil servants, but it still remains longer than that of other workers (28 days). So that those who work on the country, there is nothing to complain about. Get used to the times.
