Cases of traffic accidents became more frequent with the mass distribution of vehicles of the most diverse form. And not only for the fault of drivers of cars, but also for the fault of pedestrians. What is forensic medical examination (SME)?

Recently, with a sharp increase in the number of accidents on the road, the FMS is increasingly in demand, both among the population and law enforcement agencies. This is a very complicated and expensive procedure, which is conducted by forensic doctors. And the requirements that are imposed on such specialists are very high. Therefore, accordingly, and their labor is paid well. Why is SME carried out?

SMEs are especially often used for road accidents. At the same time, specialists who will conduct a complex of medical measures should have high qualifications. Their task is to establish the time of the accident, document the examination of injuries received, determine the speed of the car, etc. In fact, the FME allows you to "shed" light on what happened after an accident and establish all the causes and circumstances of the incident. It should be remembered that forensic doctors can also be wrong. Often they receive complaints due to incorrect timing of an accident or the death of a pedestrian, mistakes and inaccuracies in determining the severity of injuries received, and much more.

Where is the SME conducted?

To date, Russian legislation recognizes both state expertise and non-state expertise.

Non-governmental (private) forensic medical examination during road accidents is conducted in non-governmental medical institutions and expert laboratories. At the same time, state expertise is conducted in the Bureau of Forensic Expertise with the help of state experts.

The requirements are the same for both cases. Everyone has the right to resort to forensic examination, but this requires a decision of the investigating authorities or the court.

The state medical examination is carried out at the expense of budgetary funds, and the victim does not spend his money. At the same time, the court indicates the cost of SME services, but in practice all costs are borne by the state. But at the same time, the state forensic medical examination with an accident has a huge drawback. Examination can be conducted for several months, even despite the fact that by law experts are required to give their opinion within 30 calendar days from the receipt of all necessary documentation at their disposal.

But non-governmental expertise can please its customers with the lack of queues and the speed of rendering services. However, all costs in this case will lie on the victim, the state does not compensate. The result of the research can be obtained the next day, and the cost of such pleasure will be from several thousand to several tens of thousands of rubles.

Types of forensic medical examination

After an accident, all the perpetrators of the "celebration" are sent to the FMS. Experts distinguish several types of examinations that will be conducted:

  1. Independent (pre-judicial) examination.
  2. Integrated, commission and unilateral examination.
  3. Repeated (it's optional) and a primary examination.

If the causes of the accident do not cause any controversy between both parties to the road accident and law enforcement agencies, the court will appoint a one-way medical examination. At the same time, if the circumstances and causes of the accident are not clear and cause doubts and disputes, the court will send the participants of the incident to the commission of the FRA. If, in the course of the investigation, specialists with a more extensive knowledge base are needed on a particular issue, the court will decide to conduct a comprehensive examination.

The primary forensic medical examination in case of an accident should provide answers to all questions of interest to judicial officers. If the answers are inaccurate or incomplete, the court may request additional research. But a repeated MRA is carried out if the court or some side of the accident has doubts about the qualification and competence of the medical expert, or the data used in making the expert decision are unreliable.

The main tasks of forensic medical examination

During a full and extensive investigation of the facts of the accident (by the way, the investigation will be grateful if the victim or one of the witnesses takes a photo of the accident), in addition to general issues (the cause of the accident, the time of the collision, the causes of death, the nature of injuries and the degree of alcohol or drug intoxication) Experts should also answer a number of other questions, in particular:

  • Determination of the presence of injuries and injuries resulting from a car accident;
  • Nature of damage: falling out of the vehicle, impact, moving, collision or injury in the car;
  • The establishment of the movement of the car and the fact of dragging the victim along the carriageway;
  • The definition of the type of vehicle (car, truck, bus, trolleybus, etc.);
  • The analysis of the state of health of the victim before and after the accident;
  • Clarification of the capabilities of the car brand on the ability to cause this or that type of damage;
  • Determining the place of the accident and the direction of movement of the car, as well as determining the type of wheels that injured (rear or front);
  • Determining the position of the victim at the time of the accident;
  • Determination of vehicle speed.

The latter task is considered to be one of the main tasks in the conduct of the FRA, since the nature and type of injuries and injuries in the victim can determine whether the vehicle was moving at an allowable speed or not.

How much does it cost to conduct a forensic medical examination for citizens?

The forensic examination after the road accident is quite an expensive procedure, so many citizens are wondering how much they will have to pay for it. I want to immediately clarify that if you decide to pass the state examination, then you do not need to pay for anything. All expenses for examination are incurred by the state. But it is worth recalling that this procedure is rather lengthy in time and may take several months.

If you do not intend to wait that long, you have the right to apply to non-state expert laboratories, whose employees will gladly provide you with related services, but for a fee. The amount of payment will depend on the region, urgency and complexity. Currently, the average cost of FMEs in non-state institutions is about 10 thousand rubles. At the same time in Moscow and St. Petersburg, the cost of FME can reach up to 25 thousand rubles, and in rural areas it can be estimated at 2-5 thousand rubles.

It should be understood that forensic medical examination in case of an accident must answer a number of questions. And the more these questions, the more will be the cost of rendering services. Therefore, in order to obtain reliable data on the cost of forensic medical examination, you need to directly contact the experts of the expert laboratory.
