Where to get a certificate of criminal record

Very often a person has circumstances in which he is required to provide a document confirming the fact that he is "clean before the law." Such circumstances include, in particular, the employment of a citizen. Indeed, it is not possible to get a job as a notary, lawyer, teacher, auditor without the above document. It will also be required to provide it in case the person plans to adopt someone or receive an official permit to carry weapons.

At the same time, many remain completely bewildered: where to get a certificate of absence of criminal record and how to do it? This issue is regulated by a special instruction (Order of the Ministry of Internal Affairs of the Russian Federation No. 965 of November 1, 2001).

The normative legal act contains a direct indication of where to obtain a certificate of absence of a criminal record. Data on this are in the central information and analytical department of the Ministry of Internal Affairs of the Russian Federation. About where to receive a certificate of absence of a criminal record, those who are going to move abroad to live permanently, as well as persons who are on the territory of the Russian Federation in the status of an alien or who do not have the citizenship of our country, should know.

In order to receive the above-mentioned document, the person concerned must apply with the relevant authorities. The applicant (in case of impossibility to deal with this independently) has the right to authorize a third party for this purpose, having issued a power of attorney to him.

As for the guardians and minors who also have a rather vague idea of where to obtain a certificate of absence of a criminal record, the document is issued to them on the basis of their written request or statements of their parents and guardians. The latter must prove the fact of kinship or guardianship.

Foreigners and stateless persons who are outside the borders of Russia are also required to obtain a certificate of non-conviction. Decisions on the above categories of citizens are accepted by Russian diplomatic missions and consular offices.

If it is established that the applicant was subject to criminal prosecution in the Russian Federation, the question of providing him with a certificate of absence of a criminal record will be resolved taking into account the legal norms contained in a number of articles of the Criminal Code of Russia.

If the information on the criminal record is not confirmed, the document is drawn up on a special form of the series A. In the case of establishing an unexpunged or unexpired criminal record, the certificate is drawn up on letterhead B.

Decisions on the applications of the applicants are accepted within one month.

If there is a need to conduct a more thorough examination, in particular, if it is a question of convicted persons, the time for consideration of the matter may be increased.

Often there are situations when a document is required immediately. Then the interested person can apply to a specialized company that, for a certain fee, will render him a service called "certificate of criminal record urgently".

The prerogative of putting an apostille on the document is assigned to the staff of the Main Information and Analytical Center of the Ministry of Internal Affairs of the Russian Federation.
