What is the penalty for the absence of the sign "spikes"? The sign "spikes" is obligatory or not

Driving a car in winter is fraught with a lot of risk and some peculiarities. On the roads snow and mud, maybe even ice, so that the conditions for the accident are the most suitable. And then for some car enthusiasts, the question becomes especially urgent: "What is the penalty for the absence of the sign" spikes "?" And anyway, do you need it and why?

Winter tires

In the middle of autumn, many Russian motorists begin to think about "re-bumping" their iron horses. Firstly, nobody wants to stand in lines at the tire store, and secondly, it is believed that even at low positive temperatures even in the absence of precipitation, summer tires lose some of their properties, as a result of which the car loses control. Of course, there are still universal all-weather tires, but Russians learned by bitter experience that it is better to "change their shoes" - this makes trips safer, and each kit will wear out more slowly. In addition, most have long realized that it is not enough to spend once and buy a good car - since its acquisition it will also become a source of fuel, accessories and maintenance. And thus it is not necessary to be greedy, after all at the road accident even the most insignificant trifles can become defining.

Spikes or Velcro?

Previously, there was no choice, so I did not have to think about it. Now between motorists every now and then a debate breaks out on the theme: "Which is better?" Some believe that the Velcro is designed exclusively for a mild European winter, and simply does not trust this technology, preferring something simpler and more understandable, but having good adhesion to the coating. Their opponents, however, argue that the "thorns" sharply reduce the stopping distance (even compared to the summer) and are only necessary when there is a crust on the road. In addition, modern motorists in critical situations are assisted by various electronic systems, for example, ABS.

Fortunately, the roadway in winter is regularly cleaned, so this situation arises extremely rarely. Another argument of fans of "stickies" is that they do not have to put a sign on the car "spikes" (SDA does not provide a special designation for cars with winter tires of a different type). Whatever it was, the controversy continues. The choice is now huge, and this applies to both the type of rubber and its value. Meanwhile, for opponents of "stickies", the question is relevant: "What is the penalty for the absence of a sign" spikes "and is it legitimate at all?" Every winter many people face problems with traffic police.

Talking about what is still better is useless: in discussions on this topic, many copies have been broken. The controversy refers to the laws of physics and sprinkles with special terms, builds charts and charts, but practice, namely independent winter tire tests, shows that the "thorns" effectively stop the accelerated car. But the choice is for each individual motorist, if only he respected the rules.

Sign "Thorns"

SDA contains this pictogram in clause 8 of the Regulation on the admission of the vehicle to operation. It defines this sign as an equilateral white triangle with a vertex up in the red border, in which the black letter "Ш" is inscribed. At the same time it is stipulated that each side of it should be at least 20 centimeters in length.

The pictogram is quite impressive. It is not surprising that many motorists do not want to use the traffic sign provided by the SDA "Spikes". Penalty and disassembly with DPS, they, apparently, do not fear. Obviously, much more important for them is a good overview through the rear-view mirrors. Finally, many people think that this is just plain ugly. Something else to explain the general absence of the sign "Thorns" is quite difficult.

I need ...

It is difficult to answer this question unequivocally. The sign "Thorns", like its mention in the SDA, arose in 1993, when winter tires of this type only began to appear on Russian roads. Then it was for a few, but seriously changed some of the characteristics, so it was necessary to warn all other drivers.

Now summer or all-weather tires in the winter - an exception, and not a rule. But the norm in the law remained: when using tires of the appropriate type, the sign "Thorns" is mandatory.

… or not?

Here lies a curious incident, which generates the ground for heated debates and discussions. The fact is that the penalty for the absence of the sign "Spikes" by the Code on Administrative Violations (CoAP) is not provided. That is, there is a violation, but no consequences. So, to the question: "What is the penalty for the absence of the sign" Spikes "?" The answer is simple - no, but it's in theory, but in life, as is often the case, everything is somewhat more complicated.

On practice

Yes, most of the motorists who prefer spiked rubber do not bother sticking the corresponding sign on the car. Others, on the contrary, travel with it year-round, even in the summer when they use summer tires. And only some people keep the law, hanging and removing when changing tires, in accordance with the SDA, the sign "Thorns." The penalty is not to laugh at them. They are not only worried about their safety by their actions, but also take off a lot of potential problems with the police and insurance companies.

"Thorns" and DPS

Despite the fact that the law says that this sign is mandatory, exploitation without it is not prohibited, but there is no penalty. Nevertheless, some DPS employees still stop such cars and even make up a protocol. In this case, the base used part 1 of Art. 12.5 of the Administrative Code, which refers to the prohibition of the operation of the vehicle in the presence of some malfunctions. Obviously, the wrong installation of the sign "Thorns" or its absence does not apply to this. Therefore, the penalty for violation of the above-mentioned article - a fine of 500 rubles - in this case is irrelevant. You can say this before the discharge of the protocol, but you can always challenge it even after, however, for this you will have to go to court. Whatever the case, the absence of punishment does not give the right to violate the law, endangering not only yourself, but also other road users - it is worth remembering.

In addition, if in winter it is necessary to pass a vehicle inspection, the tires are in spikes, and there is no sign, then the ticket will not be issued. In any case, it's better to be safe and at least carry the pictogram with you - just in case. And it is even better to observe the law and establish it when it is relevant.

In case of an accident

Nobody wants and does not like to get into an accident. And we are not talking about car accidents with casualties and wounded: even an easy blow with a slight damage to the paint and dent is unpleasant at least in the expectation of DPS and the subsequent registration of the incident, which spills over into waste of time and nerves.

And doubly seriously this winter for the non-fan of "stickies", if he does not have the sign "Thorns." The SDA and the Administrative Code, as we have already figured out, are being overlooked. But the insurance company is another matter, it's a private organization, the decision of which is rather difficult to challenge. And the current practice shows that if one of the participants has a spiked rubber in the absence of a corresponding sign, the actual culprit, referring to this circumstance, can get out of the water, especially if everything is fixed on the DVR, which now is almost everyone's. And the one who suffered in fact, will be responsible. And this will not only affect the fact that you have to solve problems with the UK - the next policy will be more expensive because of the bonus-malus ratio. What can we say about invaluable time and effort? So why is this all if you can just set the sign?

Correct location

Where to glue the sign "Thorns"? SDA answers this question clearly: on the rear window on the driver's side. The function of this pictogram is to prevent neighbors in the flow about the features of this vehicle, and therefore everyone who is behind this machine should be aware of what tires it is on to take it into account when planning its actions.

However, recently a lot of variations appeared on this subject, considering that drivers do not like short-lived signs that fall off at the end of December after precipitation. Now there are pictures that are glued to the glass from the outside, they do not have ice, they do not make it hard to clean the snow in the morning. True, they can be difficult to get rid of, but, as an option, you can use a special soft pillow in the form of a pictogram that is placed on the left side under the rear window and is perfectly visible to everyone. And in the spring it is easy to clean in the trunk for six months, so it does not create problems at all and certainly removes the question of what the penalty for the absence of the sign "Thorns."

Why is it needed?

Studded tires, in comparison with "Velcro", significantly change the characteristics of the braking distance, especially in emergency cases. With ordinary rubber it is not so noticeable. But with the spikes the car stops much faster and sharper, which can do a disservice to its owner. Usually in a collision, the one who rode from behind is to blame. But, as already mentioned, the penalty for the absence of the sign "Thorns" can be expressed in the form of a refusal to provide insurance to the culprit repair. And this later can lead to much more significant costs than repairing the bumper. So you should not really think about whether the "Spikes" sign is mandatory or not: while the traffic rules assume its presence, it is better to fulfill their requirements.

Experienced car owners in winter, in any case, keep the distance much neater than in the summer. Slippery roads, precipitation and other factors do not contribute to excessive courage. But if there is a car ahead, on which there is studded rubber and a corresponding sign hangs, you need to double your vigilance and try to visually control the distance between you and this car. Even a small hint of inhibition should provoke a slowdown. It is important to remember that no electronic stuffing will save, if the driver's own decisions and actions do not contribute to the correct development of events and the avoidance of an accident.

Pictures on rear windows

Unfortunately, this topic echoes with the question of the need for the sign "Thorns." In recent years, some people began to attract the opportunity of self-expression by decorating their own vehicle. This resulted in aerography, sticking pictures and stickers on the glass and LKP. Of course, all this is creative and shows how unusual the owner of the car, and simply allocates it from the stream. But this is also a negative moment, because such delicacies can distract neighbors in the flow, and someone wants to drive closer to see a better funny picture, and here the distance is shortened, and with it the likelihood of a good outcome in case of emergency braking is reduced. In everything you need to observe the measure, and unnecessary - though ridiculous or original - to glue the car to anything. The sign "Apprentice", an exclamation mark for beginners who received their rights less than 3 years ago, the pictogram indicating the presence of children in the vehicle, as well as the "Thorns" is perhaps all that is needed, because it sufficiently informs the neighbors about the current Or other features of this car. Good luck on the roads!
