Bringing to suicide
Russia is among the leading countries in terms of the number of suicides in the world. Most suicides are due to the adverse impact of surrounding people on the victim. In the Criminal Code of 1960, in the section "Bringing to suicide" (Article 107), a person was considered guilty only if the aggrieved party was materially dependent on him. In 1996, this article was changed. The victim could be any individual. The current article - "Bringing to suicide" - can cause accusations of any stranger who has somehow influenced the commission of suicide. For the dissemination of defamatory fabrications or threats against the victim, the suspect may be prosecuted.
Let's look at the objective side of the article "Bringing to suicide." The case starts if:
1. Disorder behavior of the accused, that is: cruel treatment, threats, humiliation of human dignity.
2. If by the actions the accused brought the victim to a dead-end situation, in which the latter felt hopeless.
3. If the victim was induced to commit suicide, and the reasons for this are due to the behavior of the suspect.
The article "Bringing to suicide" provides a clear list of punishable actions that contribute to suicide:
- threats against the victim;
- rude treatment;
- constant humiliation of dignity.
The article "Bringing to suicide" does not include any other actions. For example, it does not include the constant harassment of a beloved girl or a delay in the payment of wages. As for the qualification of threats, there are no explanations. Therefore, the investigator can take for them the following actions: violence, illegal eviction, dissemination of information of an intimate kind. But dismissal from work, which entailed suicide, can not be attributed to Article 110.
Ill-treatment is quite a valuation concept, which is used in other articles of the law. To him can be considered various cruel physical actions: beatings, rape, restriction in movement. Basically, it assumes constant, regular behavior of the accused. Repeated insults and mockeries are called in the Criminal Code the term "systematic humiliation of dignity." Suicide can be caused by both direct actions and inaction. For example, a refusal to provide food. The subjective side of this issue is contentious: some investigators may allow in this case negligence, others - indirect intent, and still others - direct intent.
