What is an investigative experiment

Investigation is often necessary. In most cases, it is used when it becomes necessary to verify by experience the data obtained during the investigation of a criminal case.

Forensics has been using it for a long time. Over the years he improved and changed. In itself, the investigative experiment is nothing more than a procedural act conducted to check the collected information and data that are important for the investigation of a criminal case. The given experiment is carried out by reconstruction of circumstances and conditions of incident. The investigative experiment is provided for in Article 181 of the Code of Criminal Procedure. Note that in some cases such a check of the collected materials is simply necessary.

Types of investigative experiment. The main goals in most cases echo:

- setting the sequence of actions committed by the perpetrator;

- Identification of the mechanisms that led to the appearance of traces of the crime;

- Determination of whether or not the crime was actually committed in the circumstances;

- confirmation of the fact that it was the accused who committed the crime.

In fact, investigative experiments are not so often.

Investigatory experiment can be appointed on the initiative of the investigator, the victim or some other participant in the criminal process. In some cases, the results of the experiment help not only to confirm, but also to obtain certain new data. It often turns out that the suspect acted not alone, but in cahoots with someone. Issue it may lack some specific skills, the inability to perform any action alone, and so on.

An investigative experiment can be conducted under the following conditions:

- the public order should not be violated ;

- the reconstructed situation should correspond to the one that was at the time of the crime;

- participants in the experiment should not be humiliated, and their lives should not be threatened;

- the suspect must give written consent to participate.

In some cases, the situation changes specifically - it helps to establish whether the suspect actually committed a crime (it happens that people for some reason or another slander themselves).

Timeliness of conducting an investigative experiment is one of the factors of its success. If there is a delay, there is a possibility that there will be any changes at the crime scene, the suspect will forget any important details or refuse to cooperate with the investigation altogether.

The investigative experiment itself is complex and time-consuming. That's why they resort to it only in those cases when it is not possible to verify all the data through interrogation, search and so on.

As a rule, special witnesses take part in investigative experiments. Best of all, if they have any psychophysical and professional knowledge - this will help them understand the meaning of what is happening. In most cases, more than two witnesses are involved in this kind of experiment. Sometimes they are used as agents of the bodies of inquiry. If necessary, special psychologists or other specialists may be invited.

In the investigative experiment, an attorney must also take part. They may be a victim, a witness.

The accused himself shows the actions performed at the time of the commission of the crime, or they are reproduced by an understudy. Victim in the immediate reconstruction of events is rarely involved.
