If in the near future you plan to go abroad for rest or on business need or want to take another loan, then it is worth checking whether you have debt to the bailiffs. It is necessary to do this, even if you are sure of your infallibility in financial matters.

Where does the debt come from?

Do you think that debts to court bailiffs are formed only by irresponsible people, malicious violators and deviators? You are not right. In fact, it is very simple to become a debtor. They forgot to pay for some services, failed to make timely tax deductions, delayed payment of a bank loan, refused to pay alimony at least once - and all: hello, arrears! Until 2013, the ban could be imposed on a person even in the event that his debt was 100 rubles. Today, this amount is increased to 10 thousand. Do not think that this is a lot, given the likely penalties and penalties, this amount can accumulate quickly enough.

Debts to bailiffs: how to find out and what to do

In order to be on the "shameful" list, you need a court decision on bringing the case to the enforcement process and your stubborn refusal to pay a fine (debt). However, there are also misunderstandings when, as a result of a system failure, an absolutely innocent person enters this list.

To avoid such misunderstandings, it is worthwhile to check independently the absence (or presence) of your name in the "debt" database. This can be done by contacting the territorial office of the FSSP at the place of residence. That's where the difficulties begin. The fact is that this institution accepts citizens only twice a week, on Tuesdays and Thursdays, and even then not all day. In addition, nobody has canceled the line yet.

On the other hand, a personal visit to the executive service will not only check the existence of debt, but also find out where it originated from. This can be very important in cases when you are sure that there are no "sins" for you.

However, you can check the debts before the bailiffs in another way, using the Internet. To date, the bailiff service is probably the most highly organized and systematized. Therefore, in order to look at the debt before bailiffs, it is enough to visit the official site where the all-Russian debtor base is located. To do this you will have to perform a few simple steps:

  1. Go to the official site of the bailiff service - fssprus.ru - and open the section "Database of executive proceedings". Such a large orange button is located on the left. Next, a special form will open, in which you can search for a physical, legal entity or the number of enforcement proceedings.
  2. The next point is to choose the region that interests you. You can do this by opening the drop-down list in the "Territorial Authorities" line. If you select the "All regions" option, the search will be conducted across the entire Russian database.
  3. Now you need to enter the rest of the data: the surname, name, patronymic and full date of birth for physical persons or the full name and address of the person of the legal. If you know the number of enforcement proceedings in relation to the person you are interested in, you should use the third tab.
  4. After all the data is entered and checked, press the "Search" button, and then the window with the CAPTCHA will open, which you need to enter, thereby proving that the request is made by a real person.

That's all, the result will be obtained immediately. If you saw the inscription: "Nothing was found by your request," it could mean two things:

  • You have no debts;
  • The bailiff service has not yet managed to deposit data about you in the all-Russian base.

If the debt is still found, a tablet will appear on the screen, which will show all the information about each debt that you have: the amount, number and date of the enforcement proceedings, the name of the bailiff leading your case and its contact details.

Check your debt with your phone

In some regions of Russia, you can check debts to bailiffs by contacting the FSSP by phone, but in this way you will only be able to find out about the fact of the presence or absence of debt. For more information, you will still have to visit the FSSP office in person.

Nevertheless, some users can still find out whether there are debts to bailiffs on the phone, however, this will not require a stationary device, but a smartphone or tablet. When the fine is transferred to the FSSP

According to Article 32.2 of the Code of Administrative Offenses, the violator has 70 days to pay a fine, of which 10 is given to appeal the protocol and 60 to pay the debt. In another 10 days, information about the debt will be transferred to the bailiff service. Thus, the general term provided to the debtor for the amicable settlement of the matter is 80 days.

A little different in the situation with the transport tax - it must be paid before 01.11 of the year following the reporting one. So, for example, the tax for 2015 must be paid before 01.11.2016, unless otherwise stipulated by the federal law of your region. Non-payment of this type of tax also leads to a meeting with bailiffs.

How to recover debts

If you have outstanding debts to bailiffs, the latter can apply to you a variety of measures of influence.

For example, if you are officially employed, the fine can be deducted from your salary. Also, foreclosure can be turned to personal property, money, bank accounts, including currency, available securities.

The most extreme measure may be forced eviction from the occupied premises, followed by its implementation in repayment of debt. Of course, in this case, the amount of debt must be very large.

One of the most effective measures is also the restriction on going abroad.

How can I repay a debt

It is not enough to find out the debt before the bailiffs, in order to avoid trouble, it must also be paid off. It is not difficult to do this: first you can find out the amount of the debt and the details of the FSSP, then make payment at any nearest bank. And you can and do not leave the house, using the online service.

Checking the availability of debt using the website, you can see that opposite to each amount that you are required to have, there is a button "Pay". Click on it and choose a method of payment, they are quite diverse - Qiwi, Webmoney, payment by credit card or using a mobile phone account. Also on the site you can create, print out an invoice for payment and use the services of the bank.

In conclusion, I want to say that information on the successful payment of debt can appear on the network only a couple of weeks after payment, even if you provide a receipt to the bailiff. Therefore, if you know about the existence of a debt, you should take care of its repayment in advance. And even better - just periodically check the presence of your name in the "black list" of debtors, in order to avoid unpleasant surprises.
